Magistro baigiamajame darbe nagrinÄjami maisto papildų reklamos teisinio reguliavimo ypatumai nacionalinÄje ir Europos SÄ
jungos teisÄje, aptariant bendruosius reklamos reikalavimus ir draudimus bei sveikatingumo teiginių vartojimo aspektus. Analizuojama praktikoje aktuali maisto papildų reklamos problema dÄl vartotojų klaidinimo, nurodant ar uÅŸsimenant apie maisto papildų gydomÄ
sias ir profilaktines savybes, kurios paprastai bÅ«dingos vaistams. Kadangi klaidinanti reklama skatina nepagrįstÄ
maisto papildų vartojimÄ
, galintį turÄti neigiamÄ
įtakÄ
vartotojų sveikatai, darbe aptariami klaidinanÄios reklamos kontrolÄs ir teisinÄs atsakomybÄs klausimai, pateikiamos rekomendacijos maisto papildų reklamos teisiniam reguliavimui patobulinti ir reklamos prieÅŸiÅ«ros kontrolei pagerinti.
The masterâs thesis deals with the legal regulation of food supplements advertising in the national and European Union law, by discussing general requirements and prohibitions for advertising, as well as aspects of using health claims. The paper examines the relevant issue of food supplement advertising that misleads consumers by stating or implying the therapeutic and prophylactic properties of food supplements, which normally pertain exclusively to medical drugs. Since misleading advertising often encourages unjustified consumption of food supplements, which may have a negative effect on the consumersâ health, the paper elaborates on the issues of control and legal liability with regard to misleading advertising. Basing on the results of the theoretical research undertaken, recommendations are given regarding improvement of legal regulation for advertising and development of its regulatory control.
