Legitimation of corporate criminal liability in the Lithuanian Criminal Law was one of leading and outstanding reforms of the legal system reflecting the realisation of modern legal ideas in reforming the Lithuanian Criminal Law. Criminal liability of enterprises is the most severe type of corporate liability, the application of which is closely related to preventing enterprises from dangerous criminal acts. The present paper aims at analysing the provisions of criminal law in Lithuania and other countries that establish conditions for applying corporate criminal liability. The author of this paper is of opinion that identification of specific features of corporate criminal liability determines more efficient application of criminal laws thereof. This paper addresses the concept of legal person as a subject of crime, regulation of corporate criminal liability, and conditions of applying criminal liability to a legal person depending directly on the doctrine of corporate criminal liability selected by the state legislative body. The paper is completed by conclusions, practical proposals, and recommendations.
