Abstract

Summary This work is committed to analyse the concept of representation in both - theoretical and practical aspects. The institute of representation was also analysed from the international point of view - the international documents as well as the local legal acts regulating the area of representation were reviewed. The work presents theoretical and practical elements, concerned with representation at the hearings of administrative cases. The main goal of the work is to elaborate the theoretical and practical aspects of representation during the hearing of administrative cases. On purpose to obtain the objective, five tasks were brought up: 1) to introduce the historical aspects of the representation institute, 2) to analyse the main aspects of the right for defence as one of the main liberties of an individual; 3) to survey the participants of the administrative law cases, their rights and duties, 4) to introduce the international legislation on representation, 5) to analyse the problems of the representation in the administrative cases in the Republic of Lithuania. The work constitutes of the theoretical and practical parts. The theoretical part involves everything that relates to representation: historical aspects, the tendencies of development, the position of the international documents and other grounds, that reflects the representation institution in the Lithuanian Republic. It was pursued to introduce the main topics in the field of the representation during administrative cases in the practical part of the work. In order to precisely estimate the problems encountered, the opinion poll in the questionnaire form among the judges of the Vilnius District Court No.1 was performed. To summarize, it might be concluded that the representation institution which is broadly regulated both – locally and internationally. Nevertheless, the scale of problems is pretty vast and it is necessary to correct the defects of regulation and form the positive attitude towards the judicial system in order to reduce it.
