Magistro baigiamajame darbe nagrinėjama Lietuvos Respublikos licencinės veiklos sistemos medeliai, reglamentavimo bei įgyvendinimo probleminiai aspektai. Ypatingas dėmesys skiriamas ir Europos Sąjungos teisės aktams reglamentuojantiems licencines veiklas Europos Sąjungos lygmeniu. Akcentuojama Europos Sąjungos ir Lietuvos teisės aktų nuostatų nesuderinamumas ir prieštaravimai. Pirmoje magistro baigiamojo darbo dalyje apžvelgiama licencinės veiklos samprata, sąvoka, reguliavimo teisiniai, ekonominiai, vadybiniai ir kitokie socialiniai reguliavimo poreikiai, licencinės veiklos įteisinimo pagrindai bei teisės aktai reglamentuojantys licencinę veiklą. Autorė daro išvadą, jog norminiuose teisės aktuose gana detaliai ir išsamiai reglamentuojama licencinės veiklos sistema bei santykiai tarp subjektų, tačiau atsižvelgiant į tam tikrų sektorių specifiką bei ypatumus vis dar susiduriame ir su tam tikrais neatitikimais bei prieštaravimais, sudarančiais galimybes biurokratizmui, diskriminacijai ar piktnaudžiavimui.
The Master’s final thesis provides the analysis of the models of the system of the license activity of the Republic of Lithuania, of the problematic aspects of regulation and of its implementation. A special attention is also devoted to the legal acts of the European Union, which regulate the license activity at the level of the European Union. Lack of conformity and contradictions of the provisions of legal acts of the European Union and Lithuania are stressed. The first chapter of the Master’s final thesis provides the review of the concept and meaning of licensing, of the legal, economic, management and other social regulation needs, of the basics of legalization of license activity and the legal acts, which regulate the license activity. The author draws the conclusion that the system of license activity and the relations between the entities are regulated in detail and exhaustively in the normative legal acts. However, with taking into consideration the specific nature and peculiarities, we still run into certain inconformity and contradictions, which create the possibilities for bureaucracy, discrimination or misuse. The second chapter of the Master’s final thesis provides consideration of the range of institutions, which regulate the license activity; the persons, who can obtain the license to carry out the definite licensed activity. Moreover, a list of the types of license activity and the types of the issued licenses are submitted. Seeking to provide the detailed static-dynamic analysis of the system of license activity and to reveal the gaps (shortcomings) of regulation, the author considered provisions of the regulations of the selected sectors with taking into consideration authorization of the institutions, which issue licenses, the conditions and requirements, raised towards issuing of the licenses and towards refusal to issue them as well as responsibility for violation of the license activity. The third chapter of the Master’s final thesis is devoted to problematic aspects of implementation and to possible ways of their solution. The main attention is devoted to the term of validity of the non-terminated licenses, to issuing of licenses by applying the public procedures and the simplified order of implementation of the model of the license issuing. With taking into consideration the results of interrogation and the arguments, submitted in the present thesis, the author draws the conclusion that, seeking to avoid sanctions of the European Union and with taking into consideration the impact of the social changes, the business demands and competition, it’s necessary continue improving and modernizing the system of the licensed activity.
