Nusikalstamų veikų registravimas ikiteisminio tyrimo įstaigoje - policijoje: procesinio ir organizacinio pobūdžio problematika

Magistro darbe nagrinėjamos nusikalstamų veikų registravimo policijoje problemos. Darbo aktualumą lemia tai, kad nusikalstamų veikų registravimo stadija yra viena svarbiausių baudžiamojo proceso etapų, nuo kurios priklauso tolimesnė baudžiamojo proceso eiga, asmens teisių užtikrinimas ir visuomenės pasitikėjimas teisėsaugos institucijomis. Praktikoje pasitaiko situacijų, kai pranešimai apie galimas nusikalstamas veikas nėra registruojami laiku arba jų registravimas vilkinamas, todėl kyla klausimų dėl teisės normų taikymo nuoseklumo ir proceso teisėtumo. Darbo tikslas – išanalizuoti nusikalstamų veikų registravimo policijoje problemas ir nustatyti pagrindinius veiksnius, darančius įtaką šiam procesui. Tyrimo metu buvo analizuojami teisės aktai, teismų praktika ir mokslinė literatūra, taip pat atliktas empirinis tyrimas, kurio metu apklausti 119 policijos pareigūnų ir 68 asmenys, kurie kreipėsi į policiją dėl galimai padarytų nusikalstamų veikų. Tyrimo rezultatai parodė, kad nusikalstamų veikų registravimo praktikai įtaką daro tiek procesinio, tiek organizacinio pobūdžio veiksniai. Praktikoje pareigūnai neretai susiduria su sunkumais vertindami nusikalstamos veikos požymius registravimo etape, o tai gali lemti nevienodą teisės normų taikymą. Taip pat nustatyta, kad didelis policijos pareigūnų darbo krūvis, vidaus norminių dokumentų taikymo ypatumai ir informacinių sistemų veikimas gali turėti įtakos registravimo proceso operatyvumui ir kokybei. Darbe taip pat aptariama vadinamoji nusikalstamų veikų registravimo „pilkoji zona“, kai pranešimai apie galimas nusikalstamas veikas nėra aiškiai nei registruojami, nei formaliai atmetami. Remiantis atlikta analize ir empirinio tyrimo rezultatais, darbe pateikiamas autorinis „raudonų vėliavų“ modelis, skirtas identifikuoti situacijas, kuriose kyla didžiausia nusikalstamų veikų registravimo problemų rizika, bei siūlomos pagrindinės nusikalstamų veikų registravimo policijoje tobulinimo kryptys.
This master's thesis analyzes the problems of criminal offence registration in the police. The relevance of the topic lies in the fact that the stage of registering criminal offences is one of the most important stages of criminal proceedings, as it determines the further course of the criminal process, the protection of individual rights and public trust in law enforcement institutions. In practice, situations occur when reports of possible criminal offences are not registered in a timely manner or their registration is delayed, raising questions regarding the consistency of legal regulation and the legality of procedural decisions. The aim of the thesis is to analyze the problems of criminal offence registration in the police and to identify the main factors influencing this process. The research methods include the analysis of legal acts, case law and scientific literature, as well as an empirical study. During the empirical research, 119 police officers and 68 individuals who had reported possible criminal offences to the police were surveyed. The results of the research show that both procedural and organizational factors influence the practice of criminal offence registration. In practice, police officers often face difficulties when assessing whether the received information contains elements of a criminal offence at the registration stage, which may lead to inconsistent application of legal norms. The study also revealed that a heavy workload of police officers, internal regulations and the functioning of information systems may affect the efficiency and quality of the registration process. The thesis also discusses the so-called “grey zone” of criminal offence registration, when reports of possible criminal offences are neither clearly registered nor formally rejected. Based on the conducted analysis and the results of the empirical research, the thesis proposes an original “red flags” model intended to identify situations where there is a higher risk of improper registration or delayed registration of criminal offences. In addition, the main directions for improving the criminal offence registration process in the police are presented.
