The principal issue of this work is to evaluate the submission of the new evidence on appeal. The topic has never been covered by a separate study so this work is orientated to broader and deeper analysis of the issue. Author aims to overview the basic principals of the submission accordingly to the models of the appeal. This study discus what influence models of appeal makes to procedures of the submission of new evidence. Author also analyses different problematic issues concerning the topic, including the submission of the new evidence in different systems of appeal, different legal framework and approaches to the procedures on submission of the new evidence as well as advantages and disadvantages of submission of the new evidence in both models of the appeal. In this paper author pays exclusive attention to the system of the submission of the new evidence on appeal implemented in Lithuanian law. This is done by raising substantional questions on the topic accordingly to the specifics of Lithuanian legal regulation of the appeal procedures and the nature and objectives of the prohibition to submit new evidence on the appeal. Critical approach to the legal practises including decisions made by Supreme Court of Lithuania is presented, notice to essential issues is brought and suggestions are made.
