There is described in short the final work in summary, its structure and there is presented the actuality of theme, of chosen final work. Also, there are summarized the aim and outcomes of final work. The final work consists of three parts divided into six chapters. The author of final work inducts the concept of discretionary in the modern practice of police officers, also, there is discussed the possibilities of discretionary control and the peculiarities of officers’ respond. The author rises the aim for the final work to determine, summary the problems, connected with the implementation of discretionary powers of police officers in practice, to disclose the peculiarities of detection of respond of modern police officers’ work The discretionary in the modern officers’ work means that officers, working according to their competitions, have some sphere of autonomy where they can choose one of alternative ways of action or to make decisions. The power of discretionary allows police officers to act more flexible, paying attention to every particular event and its circumstances and to accept the right, rational and proved decision. Either, it allows to be guided not only by “the letter of law”, but by “the spirit of law” as well. There are set three fundamental categories of police discretionary power control: legislator (parliamentary), inner and judicial in Lithuania. The control of police discretionary is the legal basis of police discretionary practice and the efficient mark of governmental subjects, which do the legality control of police practice, should be kept as the safety warranty level of human rights and liberty. During the research was done the analysis of statistic and police discretionary control mechanism elements and it’s showed that the mechanism of police officers’ control acts effectively. Also, it’s possible to predicate according to tendency of malfeasance declining number that in the near future should remain the tendency (approx. 10℅ per year) of malfeasance declining. Though, too strict control could reach very dangerous line, when police itself wouldn’t be able effectively do its main practice- to discipline criminal aggression and protect the law using legal means, so why the discretionary of police officers and control itself should always be the object of researches.
