FinTech and the Revised Payment Services Directive (PSD2): a Non-Discrimination Obligation on Banks

This paper outlines the notion of sharing data and the obligation to grant access to third parties as a component of the non-discriminatory duty in the B2B sector with an aim to provide effective competitiveness declared by the EU. The Thesis provides an analysis of the obligation of non-discrimination on banks as well as the mechanism of its implementation which is granted by PSD2. The research is based on guidelines of the European Commission, European Data Protection Board, CJEU practice, and reports of expert groups. The study's objectives include examining the current situation and issues, as well as potential solutions to strengthen the law against discrimination against FinTech while taking into consideration both the difficulties of the present and the challenges of the future.
