In recent years it can be heard quite often about social business (or social entrepreneurship) initiatives. Different definitions of this phenomenon are being provided. The lack of legal certainty requires for a thorough examination of social business as a legal category. The paper aims to identify the basic legal preconditions of social business in the European Union and to show the complexity of the concept of social business phenomenon. The authors look for basic categories in legislation of the EU in the area of social business and examine main views of the academic researchers regarding this topic. Authors come to main conclusion that existing legal forms in the EU are too narrow and vary from state to state. In such situation there must be found and defined legal preconditions (common approach) – what could be considered specifically as social business or social entrepreneurship.
