The article aims at systematically analyzing implementation issues of European Union (hereinafter – EU) legislation governing blood donation in Lithuania, identifying the weaknesses in the national blood supply system. In order to achieve the aim, the following tasks have been set: to evaluate the implementation of the Directive 2002/98/EC in Lithuanian legislation; to evaluate the deficiency of state legislation regulating blood donation; to provide suggestions for regulating blood donation in Lithuania. All EU member states should ensure the high quality standards of blood and blood components. After having analyzed the implementation of the Directive 2002/98/EC in Lithuanian legislation in the first section, turns out that the Blood Donation Law provides too broad concept of blood donation contrary to the norms of aforesaid Directive. Also the discrepancy of the Directive 2002/98/EC in the Lithuanian language and announced original text led almost the decade of bad implementation in Lithuanian national legislation and the identification of blood donation institutions and hospital blood banks functions.Since blood donation consists of several stages, one of the main principles of blood donation is the assurance of blood safety at each stage. The analysis of legislation regulating the blood supply system has shown that the regulation of blood donation in Lithuania has drawbacks. In particular, the principle of juridical state is violated by determining the conditions and procedure of blood collection, production of blood products, transfusion of human blood and blood product in secondary legislation. There is no clear regulation of donors’ blood or the parameters of blood, no test methodology, pharmaceutical legislation does not apply to the collection of raw material for the production of blood medicine, in addition, the procurement organization for acquiring blood components discredit the idea of donation itself and demotivate donors.
