This paper examines some of the problems in implementing negotiation and mediation practices in Lithuania. As a transiting society Lithuania can be characterized by a great number of conflicts in social, public and private life. The problems of a legal, social and cultural nature arise in relation to the dissemination of ADR. The perspective of strengthening the culture of cooperation and conflict resolution, with an emphasis on mediation, is reflected.
