The adoption and rapid development of legal regulation regarding the limitation of illegal immigration into Latvia was due to preparations for accession to the European Union in 2004 and accession to the Schengen Agreement. European integration processes have necessitated the establishment of an effective compensatory mechanism in order to prevent the negative effects of free movement of EU citizens and foreigners in the European and Schengen area and creating a legal regulation that would ensure the prevention of illegal immigration would prevent the spread of international crime and other negative phenomena caused by the abolition of border checks at internal borders of Latvia. State Border Guard of the Republic of Latvia is the main agency in control of foreigners’ residence in the country, and has a broad competence in matters of asylum. With the amendments to the law Border Guard on Jan. 5, 2002 the State Border Guard Police fully took over the functions of immigration control from Immigration Police. On October 31, 2002 the Immigration law came into force on, which subsequently issued with Orders of the Cabinet of Ministers has become a fundamental in regulatory activities to prevent illegal immigration.
