2000 m. Lietuvos Respublikos BK 20 straipsnyje numatytos juridinio asmens baudžiamosios atsakomybės sąlygos tapo šio straipsnio tyrimo objektu. Straipsnyje siekiama išaiškinti dviejų savarankiškų juridinio asmens baudžiamosios atsakomybės modelių turinį, juridinio asmens baudžiamumo sąlygas, šių modelių panašumus ir skirtumus.
Analysed in the article is one of the central issues in the reform of criminal law of the Republic of Lithuania, which is the consolidation of corporate criminal responsibility in the new Criminal Code. The author has endeavoured to disclose the substance of legal persons, as subjects of criminal responsibility, and on the basis of the ?realist? view has given theoretical basis for the application of corporate criminal responsibility. Based on writings of legal scholars the author has made an overview of models of corporate criminal responsibility abroad. Having analysed the conditions prerequisite for criminal responsibility entrenched in Article 20 of the Criminal Code of the Republic of Lithuania, the author concluded that the responsibility of legal person is based on substitution. The author has distinguished two self dependent models of corporate criminal responsibility which are consolidated in parts 2 and 3 of Article 20 of the Criminal Code of the Republic of Lithuania. The author has also analysed conditions for the responsibility entrenched in the two models and has explained the features and contents of conditions consolidated in the law and has also shown differences and similarities between the two. Based on theoretical provisions the author has raised the problem of the element of fault (mens rea) of legal persons as a precondition for criminal responsibility. The article abounds in practical examples which serve as background illustrations theoretical speculations.
