В статье приводится анализ проблемных вопросов контрабанды сигарет, связанных с ситуационными факторами, оказывающими влияние на контрабанду сигарет. «Основные риски и угрозы, связанные с преступлениями, с которыми Европа столкнулась сегодня, а именно терроризм, тяжкие преступления и организованная преступность, контрабанда наркотиков, киберпреступность, торговля людьми, сексуальная эксплуатация несовершеннолетних и детская порнография, экономические преступления и коррупция, контрабанда оружия и трансграничная преступность, чрезвычайно быстро приспосабливаются к переменам, происходящим в науке и технологиях, в своем стремлении незаконно пользоваться и подрывать ценности и благополучие нашего о т крытого общества».
The article analyses the problematic issues of cigarette smuggling related with situational factors that influence cigarette smuggling. The main dangers and threats of criminality, which are currently faced by Europe, for example, terrorism, grave crimes and organised crime, trafficking in drugs, smuggling, trafficking in human beings, economic crimes and corruption, trafficking in guns and transnational criminality, are capable o f adapting, with extreme mobility, to scientific and technological changes while pursuing the aim to benefit unlawfully from the values and welfare o f open societies and to undermine them". In light o f the changing processes within the modem society and their influence on the national legal system, today it is highly essential to answer the question, which situational factors influence cigarette smuggling offences. Crime is growing rapidly, its structure undergoes transformation and more serious and pre-arranged offences are being committed. Criminal associations and organized groups are increasingly gaining their positions within the criminal world. The resulting criminogenic situation not only forces to improve the crime control mechanism, but also requires looking for the new methods and measures in order to improve the investigation of offences. The article presents the analysis o f relationship between the situational factors that influence cigarette smuggling, examines relationship between the situational factors and the dynamics of offences, presents the general features characteristic to cigarette smuggling offences as separate social phenomena.
