Europos Parlamento ir Tarybos reglamento (ES) Nr. 650/2012 taikymo problemos įgyvendinant paveldėtojų teises

Šiame darbe analizuojamos paveldėtojų teisių įgyvendinimo problemos, galinčios kilti nuo 2015 m. rugpjūčio 17 d. pradėjus taikyti 2012 m. liepos 4 d. Europos Parlamento ir Tarybos reglamentą (ES) Nr. 650/2012 dėl jurisdikcijos, taikytinos teisės, teismo sprendimų paveldėjimo klausimais pripažinimo ir vykdymo bei autentiškų dokumentų paveldėjimo klausimais priėmimo ir vykdymo bei dėl Europos paveldėjimo pažymėjimo sukūrimo. Analizuojamos daugiausiai neaiškumų galinčios sukelti Reglamento nuostatos, kurių klaidingas interpretavimas gali sukelti paveldėtojų teisių pažeidimą. Tyrimas atliktas analizuojant Reglamento priėmimo tikslus, skirtingų autorių nuomones dėl tam tikrų Reglamento nuostatų taikymo, siekiant išspręsti problemas, galinčias kilti taikant Reglamentą.

This paper is focused on problems of application of the Regulation (EU) No 650/2012 of the European Parliament and of the Council when implementing the rights of the heirs. The provisions of the Regulation No 650/2012 which may lead to the most uncertainties are being analysed. The misinterpretation of the Regulation No 650/2012 may lead to an infringement of the rights of the heirs. The study was carried out in an analysis of the objectives of the Regulation's No 650/2012 adoption, the opinions of scientists on the application of certain rules of the Regulation in order to resolve the problems that may arise from the application of the Regulation.
