Magistriniame darbe nagrinėjama aborto teisinio reglamentavimo problematika. Tai sudėtingas teisinis santykis, nes liečia pagrindinę žmogaus teisę – teisę į gyvybę. Įvairios valstybės pasirenka skirtingus kriterijus reglamentuodamos abortą, tačiau netgi tos, kurios leidžia abortą neneigia fakto, kad gyvybė prasideda nuo pradėjimo, ir vis labiau linkusios atsisakyti aborto kaip šeimos planavimo priemonės. Lietuva priskiriama prie tų valstybių, kurios leidžia abortą dėl socialinių priežasčių, todėl pirma problema – nepakankamas aborto teisinis reglamentavimas. Remiantis lyginamuoju analizės metodu ir užsienio valstybių praktika yra siekiama pateikti aborto įstatymo hipotetinio modelio pagrindines gaires.
At this time, abortions in Lithuania are performed according to the Health Ministry order which was passed in 1994 and is called “Regarding the Performance of Operations Terminating Pregnancy”. Because abortion is a complex social relationship, it should be regulated by law. The importance of the constitutional law in the regulation of human life protection before birth is very significant. In an attempt to apply consistent protection for the life of a human fetus, there is a need for an opportunity for the Constitutional Court to voice its opinion. If this Court does not express its opinion, then the legislator must do that, because this is the only way a different approach to the right to life of a fetus can be avoided. Criminal law should not be the main law branch in which to focus attention while trying to assess the protection of unborn human life. It is wrong to set the goals in the criminal law before society itself recognizes the need of these goals. The objective of the legal regulation of the unborn life is the imperative prohibition of abortion. There is the same objective in Lithuania, but according to the practice of foreign countries, it is seen that neither permitting nor forbidding of abortions brings the expected results. In an attempt to give full protection to the life of a human fetus in the future, now, we need to concentrate not on the means of criminal law, but on other legal means and means outside the legal system.
