Construction is a complex process, organised by the participants in constructing process, that is devoted to solid concrete purpose – to build a construction, that would correspond the requirements of legal acts, designed documentation and would meet the expectations of the builder. Constructing process is devided into stages and reglamented by the laws, that contain minimal compulsory requirements. The purpose of legislator is to guarantee that a constructing process and a construction itself would correspond the established requirements, necessary to warrant the safety and durability of the building during its construction and exploitation. Peremptory requirements, established in the laws, do not derogate from participants in constructing process the rights and possibilities to enter into contracts and to determine different extent of their rights, duties, to determine their responsibility and its limits. By making contracts and cooperating with each other the participants in constructing process may solve a lot of questions, that arise surink the constructing process, and avoid disputes. The participants in construting process can make contracts during the whole constructing process, but such creation of contractual relationship is not chaotic, but is implemented according to the builder‘s selected scheme, containing the main question – who on behalf of the builder will make contracts with other participants and will take the risk and be responsible for completion of construction according to the agreed terms and conditions.
