In this paper author examines the impact and challenges of new digital technologies to traditional copyright model. Article examines how alternative approaches to intellectual property regulation in the Cyberspace are different comparing to the traditional copyright model. Author argues that in the shift to new intellectual property spreading forms, legislation policies bristle with copyright difficulties in the Cyberspace. Therefore effective measures for the intellectual property regulation in the Cyberspace could be found if only traditional copyright model is modified. Paper examines three theoretic paradigms as alternative approches to traditional copyright: copyright anarchism, “fencing” theory, Open Source and Creative Commons. Paper presents few exemples of alternative copyright’s models ���� technological protection measures, electronic contracts and licences. The main conclusion of the paper is that to effectively protect intellectual property in the Cyberspace, we should rethink traditional copyright model in the light of Cyberspace and legal difficulties it raises. In search for alternative copyright’s models author suggests to combine traditional copyright, digital rights management and other technological protection measures and legal instruments of contract law.
