Vaiko minimalios priežiūros priemonės įgyvendinimas
Delinkventinis nepilnamečių elgesys visuomet buvo aktuali visuomenės problema. Nepilnamečiams taikomos kitokios prevencinės ir baudžiamosios priemonės nei suaugusiems asmenims. Vykdant nepilnamečių justicijos reformą, buvo pradėta taikyti vaiko minimali priežiūros priemonė. Ši priemonė suprantama kaip įpareigojimas, kurio įgyvendinimo metu vaikui gali būti teikiama švietimo pagalba, dienos socialinės priežiūros ir kitos paslaugos, palengvinančios įpareigojimo įgyvendinimą. Už vaiko minimalios priežiūros priemonės įgyvendinimą atsakingos savivaldybės. Tyrimo tikslas: išanalizuoti vaiko priežiūros priemonės įgyvendinimo teorinius ir praktinius aspektus. Tyrime naudojami metodai: teoriniai: teisinės ir mokslinės literatūros analizė; empiriniai: kokybinis tyrimas, pusiau struktūruotas interviu, tyrimo duomenų kontent analizė. Tyrimas atskleidė, kad: dažniausiai įgyvendinant priemonę skiriamas lankymasis pas specialistus, įpareigojimas lankyti mokyklą ir pasirenkamojo ugdymo užsiėmimai. Įgyvendinant priemonę sudaromas planas, įpareigojami specialistai, informuojami tėvai, renkama informacija ir rengiamos ataskaitos savivaldybės VGK. Už priemonės įgyvendinimą daugiausiai atsakingi socialiniai pedagogai ir psichologai. Vaikas ir jo tėvai dalyvauja skiriant priemonę, yra informuojami apie priemonės įgyvendinimą, įpareigojami ją vykdyti, motyvuojami, tačiau jų dalyvavimas laikomas pasyviu. Pagalba teikiama ne tik vaikui, bet ir jo tėvams, t.y. - visai šeimai.
The juvenile delinquent behaviour always was the actual problem of society. Preventive and punitive tools for juvenile are different from adults. During the of juvenile justice reform the child minimal care tool was started to apply. This tool appears like an obligation providing educational assistance, day care and other social services for better implementation of the tool. The municipalities are responsible for implementation of the child minimal care tool. The goal of the research: to analyse theoretical and practical aspects of the child minimal care tool implementation. The methods of the research: theoretical: analysis of the legal and scientifical literature; empirical: a qualitative study, semi structured interview, the content analysis of the date. The research revealed that: the visits to the specialists, obligation to attend school and non-formal education classes are the most popular measures during the minimal care tool implementation. Implementing of child minimal care tool covers the plan creating, the parents informating and collecting information about child behaviour and making report to the municipal child welfare comittee (CWC). The social educators and psychologists are responsible for the implementation of the child minimal care tool. Child and his parents participates in appointment of the tool, parents are informed about the tool implementation and oblidged to carry it out, but their involment is passive. The help is provided not only to the child, but to his parents, that means – to his family, also.
