Vilnius : Mykolo Romerio universitetas, 2017, t. 24, Nr. 2., p. 465-489Šiame straipsnyje analizuojamas teisingo bylos nagrinėjimo garantijų, kaip jos suprantamos pagal Žmogaus teisių ir pagrindinių laisvių apsaugos konvencijos 6 str. 1 d., ir komercinio arbitražo santykis. Pirmojoje straipsnio dalyje aptariami bendrieji komercinio arbitražo ir teisingo bylos nagrinėjimo garantijų suderinamumo aspektai bei nagrinėjamas klausimas, ar minėtos Konvencijos garantijos yra taikytinos sprendžiant ginčą komerciniame arbitraže. Antrojoje ir trečiojoje straipsnio dalyse analizuojama Europos Žmogaus Teisių Teismo jurisprudencija bei Lietuvos teismų praktika ir doktrina, kurioje atskiros Konvencijos 6(1) str. garantijos – t. y. teisė (kreiptis) į teismą, teisė į tinkamą procesą, nepriklausomumo ir nešališkumo principas, bylos išnagrinėjimas per kiek įmanoma trumpiausią laiką viešumo sąlygomis – buvo nagrinėtos arbitražo kontekste. Atlikta analizė leidžia daryti išvadą, jog teisės į teisingą bylos nagrinėjimą garantijos turėtų būti tiesiogiai taikytinos komerciniame arbitraže, o ne tik sprendžiant su arbitražu susijusius klausimus valstybės teisme. Taip pat pabrėžtina, jog kai kurių teisės į teisingą teismą garantijų šalys gali atsisakyti, jeigu toks atsisakymas atitinka jam keliamus reikalavimus. Europos Žmogaus Teisių Teismo praktika leidžia manyti, jog paprastai šalys vien sudarydamos arbitražinį susitarimą atsisako teisės kreiptis į teismą ir viešo bylos nagrinėjimo. To paties negalima pasakyti apie teisę į tinkamą procesą bei nepriklausomumo ir nešališkumo principą. Šių garantijų atitinkami elementai gali būti adaptuoti arbitražui, atsižvelgiant į jo sutartinę prigimtį, tačiau arbitražinio susitarimo sudarymas savaime nereiškia jų atsisakymo, o šių principų pažeidimas gali būti laikomas procesinės viešosios tvarkos pažeidimu

Vilnius : Mykolo Romerio universitetas, 2017, t. 5., p. 88-98Purpose – the purpose of this paper is two - fold: first, to analyse the application of the c ompetence - competence principle in three jurisdictions (France, Sweden and England) and, second, to evaluate the application of the competence - competence principle in these jurisdictions vis - à - vis the aim to balance the need to give effect to arbitration ag reement and legitimacy of arbitration proceedings. Design/methodology/approach – comparative and systematic analysis as well as linguistic and teleological methods were used in this research. Finding – the principle of competence - competence is defined a s the cornerstone of commercial arbitration, however, its application varies substantially depending on the jurisdiction. Comparative analysis shows that the extreme applications of a negative effect of the competence - competence principle do not balance, b ut rather favour either giving an effect to an arbitration agreement or to the legitimacy of arbitral proceedings, and these approaches have considerable downsides. The intermediate approach, which attempts to balance these two objectives depending on a nu mber of particular circumstances, appears to be the most preferred one. For that purpose, legislators, while balancing the effect of the negative competence - competence effect, use a number of useful tools, such as: (i) court’s prima facie review of arbitra l jurisdiction (ii) different standards of review depending on the nature of challenge (e.g. whether the existence or only the scope of the arbitration agreement is challenged); (iii) different standard of review depending on whether arbitral proceedings h ave been commenced or not.
