Abstract
Straipsnyje analizuojami 1993 m. balandžio 5 d. Tarybos direktyvos 93/13/EEB dėl nesąžiningų sąlygų vartojimo sutartyse taikymo praktikoje tam tikri aspektai. Straipsnyje pateikiama ir Valstybinės vartotojų teisių apsaugos tarnybos – institucijos, kuri Lietuvoje įgaliota įgyvendinti nesąžiningų vartojimo sutarčių sąlygų kontrolę – patirtis ir problemos, su kuriomis susiduriama teismuose nagrinėjant ginčus dėl vartojimo sutarčių nesąžiningų sąlygų.
- The State Consumer Rights Protection Authority has noticed from its practice that after submission of the claim to the Court the entrepreneurs often make amendments or withdraw the disputed contract terms during the judicial proceedings. As for other question, how it should be proceeded in the civil case during which the disputed contract terms have been modified or withdrawn, it should be noted that the modification of the disputed contract terms does not mean that the infringement of the public interest is ceased, since the modifications may be inadequate and minor. The withdrawal of the disputed contract term does not mean that the infringement of public interest is ceased, since the contract terms withdrawn may be not the same as the ones indicated in the claim. The Author notes that every case should be assessed individually, taking into account whether the infringement of the public interest is really ceased. In the article the Author points out that there are problems regarding application of the Directive 93/13/EEC due to inconsistent case law of the national courts. Every claim concerning invalidation or replacement of unfair terms (conditions) is very specific and often has individual issues specific to a particular claim. It is assumed that the number of problem issues in this field will be addressed in further development of judicial practice.
