Abstract (en)
The Constitutional Court of the Republic of Lithuania also links freedom of advertising to freedom of economic activity which is consolidated in Article 46 of the Constitutional Court of the Republic of Lithuania. Therefore, lawful limitations of advertising are to be considered not only as lawful limitations of freedom of information, but also as lawful limitations of economic activity. While considering limitation of advertising, in the context of limitation of commercial activity, the Federal Constitutional Court of Germany analogically noted that limitation of advertising is also linked to limitation of the right to choose business which is enshrined in Article 12 of the Basic Law of the Federal Republic of Germany.
