The lithuanian lawyers works - K. Račkauskas, P. V Raulinaitis, K. Šidlauskas, el. al - which were published in mongraphes and periodicals, showed how Lithuania was constantly preparing to become a free state and how the constitutional system of the future independent Lithuania was modelled. All authors agreed in that they saw Lithuania as an independent democratic state. Most of them agreed to the idea of replacing the virtue of the Lithuanian Constitution of 1922. But before that it was necessary to balance executive, legislative, and judicial powers. The following matters were suggested: mitigating the concentration of Parliamentary powers in one institution; creating a Second House; creating stronger executive powers; changing the order of Presidential elections; selecting half the Presidential Cabinet of Ministers; and establishing an unlimited role of the Court in the civil and penal law fields (while at the same time it regulating its work in accordance with the legality/constitutionality of laws and administrative acts). The ideas of emigrant lawyers about the future electoral system, municipalities, and some other institutions are discussed in this article.
