Not only a search for scientific truth but a wish to increase the effcctivity of action aimed at Lithuania's liberation and at shaping an appropriate international opinion stimulated the lawyers, historians and political scientists of the emigration to engage in a decades-long active analysis and assessment of the causes, course and results of the Soviet occupation Lithuania. The article makes an attempt to summarize the ideas and considerations on legal aspects of occupation expressed in the emigration press. The works of A. Gerutis, P. Mačiulis, E V. Raulinaitis, K. Šidlauskas and other authors of emigration in which the occupation of Lithuania is considered in the light of international and constitutional law are discussed. The authors of the writings maintain that the preconditions for the occupation were created by the Ribbentrop - Molotov pact and the occupation was effected by the Soviet Union which in sending its troops to Lithuania violated its international treaties. Efforts at camouflaging the act of violence by an assensibly free will of the Lithuanian nation and a repect of the constitution of the time, were, actually, a ruthless violation of the constitution. A conclusion is made that under the conditions of the occupation when investigations of this kind in the country were impossible, findings and considerations of the emigration scientists on the issues of Lithuania's Soviet occupation were extremely valuable.
