Straipsnyje tiriama teismų pareiga išklausyti vaiką su juo susijusiuose tėvų ginčuose (bylose dėl tėvų pareigų). Darbe nagrinėjami šią pareigą numatantys tarptautiniai, regioniniai ir nacionaliniai teisės aktai bei analizuojamos juose įtvirtinamos tokios pareigos ribos, be to, daug dėmesio skiriama skirtingai valstybių praktikai aptarti.
The article scrutinizes the content of the courts’ duty to hear children in family law cases. For this purpose, the authors examine international, EU and national practices also taking into account changing perceptions as to children’s role in the proceedings. The duty to hear the child is considered as a complex duty consisting of several elements. First of all, the authors refer to legal instruments establishing the right of the child to be heard. After that, the content of this right is examined in detail, considering situations when it is necessary to hear the child, the age from which the child is heard, the methods and procedure used for hearing the child, as well as the influence of their opinion to the court’s judgement. The authors conclude that international instruments and the EU legislation obliging courts to hear children in respective proceedings neither prescribe a specific age limit for the child to be heard, nor require to follow a certain procedure or methods when hearing the child. The tendencies in Europe however reveal that most often school age children will be heard by the court either directly or indirectly, and their opinion will count towards – though will not necessarily change – the judge’s say.
