Europos Žmogaus Teisių Teismo 2024 m. sprendimų bylose prieš Lietuvą reikšmė

2024 m. lapkričio 18 d. duomenimis, Europos Žmogaus Teisių Teismas (toliau – EŽTT, Strasbūro teismas, Teismas) buvo priėmęs 15 baigiamųjų aktų bylose prieš Lietuvą: 8 sprendimus (dėl bylos esmės) ir 7 nutarimus dėl peticijų (ne)priimtinumo, tarp kurių ir žymioji byla – EŽTT Didžiosios kolegijos nutarimas byloje Duarte Agostinho ir kiti prieš Portugaliją ir 32 kitas valstybes1 (tarp kurių – ir Lietuva). Taigi bylose prieš Lietuvą išnagrinėtų peticijų skaičius 2024 m. nėra gausus. Šiame straipsnyje analizuojami kai kurie įdomūs, aktualūs 2024 m. EŽTT bylose prieš Lietuvą priimti sprendimai dėl esmės ir nutarimai dėl nepriimtinumo, akcentuojant tam tikrus, manytina, svarbius aspektus Lietuvos teisės ar paties Teismo jurisprudencijos požiūriu. Minėtas Didžiosios kolegijos nutarimas byloje Duarte Agostinho ir kiti prieš Portugaliją ir 32 kitas valstybes šiame straipsnyje nėra analizuojamas.
According to the statistical data of 18 November 2024, the European Court of Human Rights (ECtHR) adopted 15 final acts in the Lithuanian cases: 8 judgments (on the merits) and 7 decisions on the (in)admissibility of the applications, among them – the important decision of the Grand Chamber of the Strasbourg Court in the case Duarte Agostinho and Others v. Portugal and 32 Others (including Lithuania)20 which is not analysed in this Article. Therefore, there were not so many judgments and decisions adopted by the ECtHR in the Lithuanian cases in 2024. Also, it should be observed that in 2024 not a single Lithuanian case was examined by the Grand Chamber of 17 judges of the Strasbourg Court. It means that Lithuanian cases were not raising important legal issues or serious problems concerning the interpretation and application of the European Convention on Human Rights (the Convention or ECHR). Furthermore, not a single Lithuanian case was examined under the pilot procedure or regarded as raising systemic or structural problems at national level. The judgment in the case al-Hawsawi v. Lithuania, adopted by the ECtHR on 30 January 2024, continued the series of so-called „secret prisons“ cases, where the Strasbourg Court had established many Convention violations not only in such type of cases against Lithuania, but also in the cases against other States Parties to the Convention. Another more interesting case of 2024 can be mentioned - Sacharuk v. Lithuania, where the Strasbourg Court established violation of the right to a fair trial under Article 6 (1) of the Convention for the reason that the same judge of the Supreme Court of Lithuania was sitting in the examination of the second cassation appeal of the applicant, although he was the presiding judge in the examination of the first cassation appeal lodged by the applicant and such situation created conditions to believe in the guilt of the applicant. Violation of Article 7 as complained by the applicant, was not established by the ECtHR in this case. As regards more interesting inadmissibility decisions adopted by the Strasbourg Court in 2024 in the Lithuanian cases, the decision in the case Kirkorov v. Lithuania could be mentioned. In this case, the famous Russian singer Kirkorov was complaining to the ECtHR about the violation of his rights under Articles 10, 14 of the ECHR, as well as under the First Protocol of the Convention about a violation of his rights to the protection of his property. The main issue in the case was stemming from the fact that this singer due to his political support to the Russian Putin‘s regime, was not allowed to enter the territory of Lithuania and to have the planned concerts here. The Strasbourg Court rejected this case as being manifestly ill-founded.
