Straipsnyje analizuojami įmonės finansiniai sunkumai. Visų pirma aiškinama finansinių sunkumų sąvoka, kilimo priežastys, sprendimo būdai. Vienas iš būdų įmonei išspręsti finansines problemas ir atkurti mokumą – restruktūrizavimas. Tačiau kartais įmonės finansiniai įsipareigojimai pasiekia tokį mastą, kad net restruktūrizavimas negali padėti, todėl, siekiant apsaugoti kreditorių interesus, reikia iškelti įmonei bankroto bylą. Straipsnyje taip pat atskleidžiama šių dviejų civilinės teisės institutų socialinė reikšmė. Įmonės finansiniai sunkumai gali būti pagrindas iškelti įmonei tiek restruktūrizavimo, tiek bankroto bylą. Straipsnyje ieškoma kriterijų, pagal kuriuos būtų galima diferencijuoti finansinius sunkumus restruktūrizavimo ir bankroto bylose, nes iš įstatymuose pateiktų sąvokų tai nėra aišku. Ieškant atsakymų į šį klausimą analizuojami įstatymai, Lietuvos teismų praktika, Lietuvos ir užsienio šalių mokslininkų darbai.
The financial difficulties of the company are analysed in this article. First of all, the conception of financial difficulties is studied, then its main reasons and the main ways of solution. One of these ways if the company seeks to avoid a bankrupt – reconstruction. But sometimes the pledges of the company amounts such a degree that reconstruction cannot help any more so for seeking to protect the interests of creditors remains one way – litigation of bankrupt. It is also exhibited the social importance of reconstruction and bankrupt in this article. The financial difficulties of company are the base both for reconstruction both for bankrupt. In this article it is searched the main criteria which can help to specialize the financial difficulties in the litigations of reconstruction and bankrupt, because now the laws gives such a conception that it is not clear when to sue for reconstruction or when for bankrupt. For trying to answer this question laws, the practice of Lithuanian courts, the works of Lithuanian and foreign scholars are analyzed.
