The present investigation examined the correspondence of judges' behaviour to the established requirements of procedural justice. The method of observation of judges' behaviour was specially constructed for this research. Observers after special training observed 103 court trials of three citys' courts and the one district court of Vilnius. The role of the court trial procedures in the formation of feeling of justice was assessed by the method of experts. The results indicated, that the correspondence of judges' behaviour to the requirements of procedural justice was very different in different situations (it fluctuates from 0 to 80 percent). It was found, that the above-mentioned correspondence depends on the peculiarities of the representation of these requirements in the processual. law. It was also confirmed, that there are considerable differences between the different styles of judging as well as between the real behaviour of judges and the evaluations of experts. The results suggest that for the instillation of the requirements of procedural justice into the criminal process we need to formulate the requirements for judges' behaviour as precise and detailed norms of law.
Для реконструщии судебного разбирательства использовалась разработанная авторами методика наблюдения за поведением судьи. Специально подготовленные исследователи наблюдали за 103 судебными заседаниями в окружном и трех городских судах г. Вильнюса. Использовался метод экспертных оценок для определения того, насколько применяемые процедуры судебного разбирательства способствуют или препятствуют формированию чувства справедливости. Полученные результаты показали, что соответствие поведения судей требованиям процедурной справедливости в различных ситуациях сильно колеблется (от 0 до 80%). Выявлены существенные различия между отдельными стилями судейства, а также между реальным поведением судей и оценками экспертов. Приводятся рекомендации по внедрению установленных требований процедурной справедливости в уголовный процесс.
