Abstract
The article is devoted to the analysis of the custom in the private Law of Ukraine as a normative prescription and legal fact. It has been established that the practice of dualism manifests itself in the fact that in the mechanism of legal regulation of civil relations, the custom, on the one hand, can act as a regulator of these relations, and on the other – a prerequisite, sometimes the basis for the emergence, change or termination of civil legal relations.
