This article examines the problems of employment relations arising from work of drivers in road transport. Due to the increased demand for road transport services in Western Europe, Lithuanian companies providing road transport services have developed the practice of sending drivers to provide services in other countries for a period of 2-3 months without returning to the country of establishment. This type of work and problems related to it is analysed in this article. The requirements of “EU Mobility Package 1” are discussed: employers’ obligation to return drivers to their place of residence, limitation for drivers to take weekly rest in a cabin of truck. Practice of special application of labour laws in relation of drivers’ working time, pay systems are described. Problem of taking of unpaid leave after long period of work for drivers (especially non-EU nationals) is described in connection with losing of social guarantees. Analysis of Lithuanian and ECJ court practice on the given topic is provided in the article.
