In this research was analysed legal regulation of Significant Market Power (hereinafter SMP) as the legal framework of electronic communications market in mobile communication sector, were discussed the conception of SMP, the basic SMP identification criteria ,examined the relation between SMP and effective competitionin in mobile communication sector and considered the aspects of SMP institutional control and supervision in mobile communication market, including legal regulation of the decisions concerning effective reconsideration process of SMP in mobile communication market. The main concepts were used: significant market power, legal regulation of significant market power, sector of mobile communication; Implementing the first proposition the conception of SMP and the basic criteria, on the basis of which SMP is evaluated, have been explained. The second objective focuses on showing the relation between effective competition and SMP. The conception of effective competition and its identification criteria have been discussed. The final objective is directed towards the evaluation of institutional control and supervision. In pursuance of proper assessment of legal jurisdiction to hear the cases concerning the evaluation of Significant Market Power, the issue of jurisprudence has been considered. The principal problems, disclosed in terms of this theme, included insufficient explanation of SMP and effective competition concepts in national legislation, incompatibility of the activity of the institutions that supervise and control electronic communications sector and absence of legal jurisdiction in the course of SMP analysis and its regulation.
