Pagrindinis šio darbo tikslas – įvertinti administraciniu teisiniu požiūriu teisės į viešųjų institucijų informaciją įgyvendinimo galimybes ir nustatyti viešosios informacijos leistinas ribas bei teisės į informaciją apribojimų sąlygas, nagrinėjant teisės į informaciją teisinį reguliavimą. Konstitucinis teisinės valstybės principas – tai universalus principas, kuriuo grindžiama visa Lietuvos teisės sistema ir pati Konstitucija. Teisinės valstybės principas aiškintinas neatsiejamai nuo Konstitucijos preambulėje skelbiamo Tautos atviros, teisingos, darnios pilietinės visuomenės ir teisinės valstybės siekio. Šis Tautos siekis sietinas su pilietinės visuomenės stiprėjimu, pagarbos žmogaus teisių principams įsigalėjimu, tinkamo viešojo administravimo organizavimu.
The main goal of the thesis is to evaluate the implementation possibilities of the right to information in public institutions in respect of the administrative law as well as to determine admissible boundaries of public information and restrictions of the right to information while analysing legal aspects of the right to information. A constitutional principle of the state is a universal principle lying at the basis of the Lithuanian legal system and the Constitution. The principle of the constitutional state can be interpreted in accordance with the objectives of an open, just and harmonious civil society and constitutional state declared at the preamble of the Constitution. This objective of the nation relates to the development of a civil society, respect to the human rights principles and appropriate organization of public administration. The freedom of self-expression and the right to information are listed among the main human rights. The right to information is recognized as a very important personal constitutional right. Constitutional provisions state that no one can hinder a person from seeking, obtaining and spreading information or ideas. However, the right to information is not considered to be absolute worth and can in certain cases be restricted by the state. While trying to keep a balance between the freedoms and rights guaranteed to a person and the interests of the society, the state applies restrictions of personal rights and freedoms in the name of the public interest and legal goal as a way to harmonize the interests of the society and a person. Admissible boundaries of the restrictions are determined by the importance of the protected values and effective priorities of the legal values. Constitutional freedoms and rights of a person in a democratic state can be restricted only by the law so as to protect the freedoms and rights of other people as well as values and goals determined in the Constitution. The necessity of the restrictions is determined by the purpose of the restrictions and how relevant they are to the legal goal. The thesis has analysed the implementation possibilities of the right to information in public institutions and admissible boundaries of presenting public information as well as conditions under which the right to such information can be restricted. To conclude it can be said that accession possibilities of the information in public institutions and restrictions to it are determined by a legal mechanism which prioritizes the constitutional rights and duties and conditions for an appropriate implementation of constitutional human rights in order to achieve the objective of an open, just and harmonious democratic society and constitutional state.
