Graduation dissertation is written by theme: „Suspect‘s right to the fair-minded legal proceeding: theory and practice “. The main used notions are the justice, removal, complaint, legal proceeding, the fair-minded process. In this graduation dissertation we analyzed actual problems about limitations that perverts the course of justice and hedge crime subjects to realise their rights in criminal process. This work consists of introduction and three main parts. At the end of this work we formulated basics results and suggestions how to improve some proceeding rules. The basic object is to analyze the main legal precautionary measures that ensures the right of a suspect to fear trial during the criminal process. By this graduation disertation’s author’s mind the object was got. In the final work we analysed the situations which let suspects and accused persons to defend their violated rights and let them to appeal the judge‘s and procecutor‘s decisions, announce the objections and to seek restoration of their violated rights. At the end of this final work we suggested how to improve some states in the Lithuanian Criminal Process. We concluded that in each foreign country the Procedural penal code is concerted with the constitution. We noticed that the criminal process has improved, but we still can see some violations of the suspect right to a fear trial.
