Anticipatory breach of contract is regulated in the article 6.219 of Civil Code of the Republic of Lithuania. This article gives the right to terminate the contract if to the date for performance it is clear that there will be a fundamental non-performance by other party. This concept is new in Lithuanian civil system. The concept “anticipatory breach” has its roots in English common law. The first anticipatory breach precedent was happened in Hochster v De la Tour (1853). In the master final work the author analyzes concept anticipatory breach of contract, haw this concept is regulated in common law precedents and in an international law, and draw the conclusion that the norm of anticipatory breach of contract in Lithuania Civil Code is not correct regulated.
