The work analyses the essence of the relation between the legal law and documentary procedures prescribed in Part IV of the Civil Procedure Code of the Republic of Lithuania, as well as a possibility to investigate civil cases using these simplified (summarized) procedures. The author covers the development of the legal law procedure and documentary procedure, the problems as regards them in judicial practice as well as the relation between processes with the previously valid reglamentation of civil procedure. Following this analysis a question arises of what the relation between legal law procedure and documentary procedure is, and whether this relation does not contradict to the nature of the institutions of the forms of summary procedure- when implementing the principle of the procedure concentration to aim at: reducing the work load at courts- not burdening courts with simple cases as they could concentrate and pay more attention to the investigation of difficult cases, anticipating the procedure of case investigation, making procedures cheaper, computerizing procedures when investigating some certain cases at court.
