Straipsnyje įrodinėjamas teiginys, kad teisė Vakaruose ir Islame pasakoja istoriją. Pirmame skyriuje analizuojama Prancūzijos konstitucionalizmo tradicija, pasakojanti Europos demokratijos istoriją. Antrame skyriuje nagrinėjama Airijos ir Lenkijos teisė, siekiant atsakyti, kokią istoriją apie bendrą Europos moralės kursą pasakoja teisė. Toliau pereinama prie Strasbūro teismo praktikos ieškant atsakymų, kokią sąžinės laisvės istoriją pasakoja teismas. Ketvirtas skyrius skirtas Islamo tradicijai. Diskusijos objektu pasirinkta Islamo teisės doktrina ir jos pasakojama istorija. Penktame skyriuje analizuojama Tuniso teisė, kuri atspindi demokratijos visame regione kursą po Arabų pavasario. Pabaigoje pateikiamos išvados.
This paper strives to prove the statement that law in the West and in Islam tells a history. At first, the tradition of French constitutionalism is analyzed which tells much about a history of European democracy. In the second chapter, the paper considers Irish and Polish law which tell about a moral course of Europe. The third chapter of the paper considers Strasbourg case law which reflects the state of freedom of conscience in Europe. With the fourth chapter, the paper turns attention to the Islamic tradition to discuss the history that an Islamic legal doctrine can tell us. The fifth chapter discusses Tunisian law which reflects the course of democracy in that region after the Arab spring. In the end, some conclusions are delivered.
