Darbe analizuojamas požiūris į asmens privatumo apsaugos socialiniuose tinkluose teisinį reguliavimą nagrinėjant susistemintą teismų praktiką ir nustatant probleminius privatumo socialiniuose tinkluose aspektus. Pažymėtina, kad iki šiol gilinantis į šią temą pasigendama išsamesnės, nuodugnesnės analizės visais minėtais klausimais; todėl pristatomu magistro darbu siekiama bent iš dalies užpildyti teorines spragas ypatingą dėmesį skiriant asmeninių duomenų privatumo užtikrinimui socialinių tinklų platformose. Šių dienų aktualumas dėl socialinių tinklų ir jų svarbiausias uždavinys yra asmens duomenų saugumas ir privatumo užtikrinimas socialinėse platformose ir portaluose, kuriuose tai gana keblu dėl įvairių prieigų prie paskirstytos informacijos gausumo ir vartotojų tarpusavio ryšio sukūrimo. Iškyla klausimas, ar egzistuoja atsakomybė už asmens teisės į privatumą pažeidimus socialiniuose tinkluose ir kas ją turėtų prisiimti. Taip pat buvo siekiama tikslas atskleisti atsakomybę už asmens teisės į privatumą pažeidimus socialiniuose tinkluose (teoriniu, teisiniu ir empiriniu aspektais), kurio objektas yra asmens teisė į privatumą ir atsakomybė už jos pažeidimus socialiniuose tinkluose. Aptarta socialinių tinklų sampratą ir vaidmens dinamiką šiandieniniame pasaulyje; apžvelgti asmens privatumo apsaugą tarptautiniame teisiniame reglamente, socialinių tinklų kontekste; išanalizuoti asmens privatumo apsaugos sampratą ir teisinį reguliavimą Lietuvoje, išryškinant atsakomybę už asmens teisės į privatumą pažeidimus socialinių tinklų kontekste; atskleisti praktines asmens privatumo apsaugos socialiniuose tinkluose įgyvendinimo problemas. Iš gautų tyrimo rezultatų empiriniam tyrimui atlikti, buvo pasirinkta 9 įvairų tarnybos stažą (nuo ketverių iki dvidešimt trejų metų) turinčių policijos pareigūnų apklausa raštu, užduodant įvairius klausimus: kaip jie supranta asmens privatumą socialiniuose tinkluose; kas turėtų apibrėžti asmenų atsakomybę už kito asmens teisės į privatumą pažeidimus socialinių tinklų platformose; kokias rekomendacijas pateiktų asmenims, norintiems apsaugoti savo privatumą virtualiojoje erdvėje. Įvairiais klausimais respondentų atsakymai pasiskirstė nevienodai, bet dauguma jų vieningai sutinka, kad norint užtikrinti asmens privatumą socialiniuose tinkluose būtinas tarpinstitucinis priežiūros organų, socialinių tinklų kūrėjų ir pačių naudotojų bendradarbiavimas. Darbas yra sudarytas iš 2 dalių: teorinė (apžvalginė) ir praktinė (empirinė). Teorinėje dalyje (1, 2, 3 skyriuose) nagrinėjama asmens teisės į privatumą ir jos pažeidimų socialiniuose tinkluose sąvoka, analizuojamas šios teisės ir jos pažeidimų reglamentavimas Europos Sąjungos ir Lietuvos Respublikos teisės aktuose. Praktinėje dalyje (4 skyriuje) pristatomas darbo autoriaus atliktas empirinis tyrimas, skirtas išnagrinėti iškeltą problemą policijos pareigūnų požiūriu (remiantis apklausos duomenimis). Remiantis tyrimo metodais: mokslinių šaltinių, teisės aktų kritinė ir lyginamoji analizė, atliekama empirinė analizė (apklausa); dedukcijos, abstrakcijos ir sintezės metodai taikomi, siekiant paaiškinti darbe vartojamas sąvokas, pobūdį mokslinėje literatūroje ir teisės aktuose įtvirtintų nuostatų, kurios yra susijusios su analizuojama tema; apibendrinimo metodas taikomas sisteminant gautą informaciją, analizuojant aktualius teisės šaltinius ir teismų praktiką.
This Master's thesis presents a new approach to the legal regulation of personal privacy protection in social networks by examining systematized case law and identifying problematic aspects of privacy in social networks. It should be noted that so far, when delving into this topic, a more detailed, in-depth analysis of all the above-mentioned issues has been lacking; therefore, the presented Master's thesis aims to at least partially fill the theoretical gaps by paying special attention to ensuring the privacy of personal data on social network platforms. The most important task of social networks is the security of personal data and ensuring privacy on social platforms and portals, where this is quite difficult due to the abundance of various accesses to distributed information and the creation of mutual connections between users. The question arises whether there is liability for violations of the right to privacy in social networks and who should assume it. The goal was to reveal the liability of individuals for violations of the right to privacy in social networks (in theoretical, legal and empirical aspects). Object is the right to privacy of a person and the responsibility of individuals for its violations on social networks. The Objectives was to discuss the concept of social networks and the dynamics of their role in today's world; to review the protection of personal privacy in international legal regulation, in the context of social networks; to analyze the concept of personal privacy protection and legal regulation in Lithuania, highlighting the responsibility for violations of the right to privacy of a person in the context of social networks; to reveal practical problems in the implementation of personal privacy protection on social networks. Research results (conclusions, suggestions )was a written survey of 9 police officers with various years of service (from four to twenty-three years) was selected for the empirical study, asking various questions: how they understand personal privacy on social networks; who should define the responsibility of individuals for violations of another person's right to privacy on social network platforms; what recommendations would they make to individuals who want to protect their privacy in virtual space. The respondents' answers were distributed unevenly on various questions, but most of them unanimously agree that in order to ensure personal privacy on social networks, inter-institutional cooperation between supervisory bodies, social network developers and users themselves is necessary. The Master‘s thesis consists of 2 parts: theoretical (review) and practical (empirical). The theoretical part (chapters 1, 2, 3) examines the concept of a person's right to privacy and its violations on social networks, analyzes the regulation of this right and its violations in the legal acts of the European Union and the Republic of Lithuania. The practical part (chapter 4) presents an empirical study conducted by the author of the Master‘s thesis, designed to examine the raised problem from the point of view of police officers (based on survey data). Research methods was critical and comparative analysis of scientific sources, legal acts, empirical analysis (survey); deduction, abstraction and synthesis methods are applied in order to explain the concepts used in the work, the nature of the provisions established in scientific literature and legal acts that are related to the topic under analysis; the generalization method is applied to systematize the information received, analyzing relevant legal sources and case law.
