Baudos bausmės reguliavimas baudžiamojoje teisėje Lietuvoje ir užsienio šalyse

Šiame baigiamajame magistro darbe analizuojamas baudos bausmės reguliavimas Lietuvoje ir jo pakeitimai. Pateikiama baudos skyrimo praktika 2010 – 2020 m., remiantis Lietuvos teismų veiklos ataskaitomis. Pateikiama baudos dydžio nustatymo praktika, remiantis baudžiamųjų bylų tyrimo rezultatais. Tiriami skirtingi baudos bausmės apskaičiavimo mechanizmai, taikomi baudžiamojoje teisėje Europos Sąjungos valstybėse. Akcentuojamas vienas iš jų – dienos baudų apskaičiavimo modelis, dėl tiesioginės sąsajos su asmens mokumu. Pateikiama teigiama ir neigiama šalių praktika taikant šį modelį. Atsakoma į klausimus kaip šį modelį būtų galima pritaikyti Lietuvoje, kad bauda būtų efektyvesnė.

This final master’s work analyses the regulation of the fine penalty in Lithuania and its amendments. The practice of imposing fines for the period 2010 – 2020 is presented on the basis of the activity reports of the Lithuanian courts. The practice of determining the amount of the fine is presented on the basis of the results of criminal investigations. Different mechanisms for calculating the penalty are being investigated in criminal law in the Member States of the European Union. One of them is the model for calculating day fines, due to the direct link to the individual’s solvency. The positive and negative practices of the countries in this model are presented. Questions on how this model could be applied in Lithuania are answered to make the fine more effective.
