Nelegalaus darbo teisinio reguliavimo pokyčiai Lietuvoje: teisinė analizė

Šio darbo tyrimo tikslas buvo išanalizuoti Lietuvoje įtvirtintus nelegalaus ir nedeklaruoto darbo sąvokas bei jų apibrėžimus, įvertinant juos Europos Sąjungos institucijų ir valstybių narių teisės aktų ir sampratos kontekste bei skirtingais nelegalaus darbo instituto raidos laikotarpiais Lietuvoje. Nustatyta, jog Lietuvos Respublikos užimtumo įstatyme nurodyta nelegalaus darbo apibrėžimo dalis yra nedeklaruoto darbo apibrėžimo atitikmuo Europos Sąjungos mastu, taip pat tame pačiame įstatyme apibrėžtas nedeklaruotas darbas savo esme yra iš dalies deklaruotas darbas, todėl siekiant tikslumo Europos Sąjungos kontekste, sąvokas (pavadinimus) reikėtų koreguoti. Remiantis šiuo metu galiojančiais įstatymais ir teismų praktika Lietuvoje, tam tikri techniniai atitinkamų formų nepateikimo ar pavėluoto pateikimo atvejai bei žmogiškosios klaidos, kai darbdavys neturėjo ketinimų nuslėpti darbo santykių bei pats pastebėjęs klaidą, ją ištaisė (nurodydamas tikslius duomenis), neturėtų būti laikomi nelegalaus darbo atvejais bei turėtų būti priskiriami prie mažareikšmių pažeidimų. Lygiai taip pat šiandien Lietuvoje nelegaliu darbu neturėtų būti laikomi atvejai, kai trečiųjų šalių piliečiai ir ne trečiųjų šalių piliečiai dirbdami statybų sektoriuje, neturi suformuoto galiojančio skaidriai dirbančiojo ID, nepaisant to, kad visi kiti reikalavimai, jog darbas būtų laikomas legaliu, įgyvendinti - todėl nelegalaus darbo apibrėžimo (turinio) dalį taip pat reikėtų koreguoti.
The aim of this study was to analyse the terms and definitions of illegal and undeclared work established in Lithuania, evaluating them in the context of the legal acts and concepts of the European Union institutions and Member States, also evaluating them in different periods of the development of the illegal work institute in Lithuania. It was found that part of the definition of illegal work in the Employment Law of the Republic of Lithuania is the equivalent of undeclared work definition at the European Union level. As well as undeclared work definition in the Employment Law of the Republic of Lithuania is the equivalent of under-declared work definition at the European Union level. Therefore, to ensure accuracy in the context of the European Union, these terms should be revised. According to current Lithuanian law and case law, certain technical cases of failure to submit the relevant forms, late submissions and human error should not be considered as cases of illegal work and should be classified as minor violations when Employer had no intention of concealing the labour relations, he identified the mistake himself and corrected it (specifying the correct data). Also, cases in which the Employee does not have a transparent worker ID in Lithuania (in the construction sector) should not be considered as illegal work if all other requirements for the work to be considered legal are met. Therefore, the definition of illegal work should also be corrected.
