Teisminės valdžios formavimo principai bei jų santykis su teismų savivalda

Šiame magistro baigiamajame darbe yra išskiriami Lietuvos teisminės valdžios formavimo principai bei analizuojamas jų veiksmingumas. Darbe tiriamas ne tik teismų savivaldos - Teisėjų tarybos, bet ir kitų Lietuvos teisminės valdžios formavimo subjektų - Respublikos Prezidento, jo formuojamos Pretendentų į teisėjus atrankos komisijos bei Seimo, vaidmuo teisminės valdžios formavimo procese atskleidžia, kad Lietuvos teisminės valdžios formavimo principai nėra maksimaliai efektyviai įgyvendinami, o tai trukdo teismams tinkamai vykdyti teisingumą. Didinti teisminės valdžios formavimo principų efektyvumą galima stiprinant teismų savivaldos - Teisėjų tarybos, vaidmenį teisminės valdžios formavimo procese.

The master thesis is devoted to the identification of the principles of the formation of the judiciary in Lithuania and the analysis of their efficiency. The study of the role of the judicial autonomy – the Judicial Council – as well as other subjects taking part in the formation of the court system in Lithuania – the President of the Republic, the Commission on Judicial Selection, and the Parliament – reveals that the principles of the formation of the judiciary in Lithuania are not implemented as efficiently as possible, which hinders the proper administration of justice. The increase in the effectiveness of these principles can be achieved by strengthening the role of the judicial autonomy – the Judicial Council – in the process of formation of the judicial system.
