Magistro baigiamajame darbe išanalizuotos teisinio reglamentavimo, numatančio energetikos sektoriuje veikiančių ūkio subjektų veiklos priežiūrą, problemos ir įvertintos nenuoseklaus ir skubotai keičiamo teisinio reglamentavimo, numatančio ūkio subjektų veiklos priežiūrą, įtaka energetikos įmonių ir vartotojų teisėms. Pirmojoje baigiamojo darbo dalyje aptariama ūkio subjektų veiklos priežiūros tikslo samprata energetikos sektoriuje. Antroje dalyje analizuojama ūkio subjektų veiklos priežiūrą energetikos sektoriuje reglamentuojančių įstatymų raida, ūkio subjektų veiklos priežiūrą reglamentuojančių įstatymų energetikos sektoriuje sistema, aptartos ūkio subjektų veiklos priežiūrą energetikos sektoriuje vykdančios institucijos bei galima šių institucijų kompetencijų kolizija, taip pat išanalizuotas Viešojo administravimo įstatymo suderinamumas su energetikos sektoriaus įstatymais. Trečioji baigiamojo darbo dalis skirta per teismų praktikos analizę atskleisti nenuoseklaus ūkio subjektų veiklos priežiūros teisinio reglamentavimo įtaką ūkio subjektų ir vartotojų teisėms. Atlikus tyrimą, pasitvirtino ginamasis teiginys, kad teisinio reglamentavimo nuoseklumo stoka ūkio subjektų veiklos priežiūroje energetikos sektoriuje ir įstatymų leidybos skuba daro neigiamą poveikį energijos vartotojų ir ūkio subjektų interesams.
This Master’s thesis analyzes the content of the legal regulation concerning the supervision of economic entities in the energy sector and evaluates the impact of inconsistent and rapidly changing legal regulation on the rights of energy companies and consumers. The first part of the thesis discusses the concept of supervision of economic entities and defines the purpose of such supervision within the energy sector. The second part analyzes the evolution and system of laws regulating the supervision of economic entities in the energy sector. It further addresses the institutions responsible for supervising these entities, the potential conflict of competencies among them, and evaluates the compatibility of the Law on Public Administration with sector-specific energy legislation. The third part employs the analysis of judicial practice to reveal how inconsistencies in the legal regulation of supervision of the activities of economic entities affect the rights of economic entities and consumers. Following the completion of the research, the thesis defense statement was confirmed: the lack of consistency in the legal regulation of economic entities' supervision within the energy sector, combined with the hastiness of the legislative process, has a negative impact on the interests of both energy consumers and economic entities.
