Darbo santykius reglamentuojančių teisės aktų taikymas valstybės tarnyboje

Magistro baigiamajame darbe atskleidžiami Lietuvos Respublikos darbo kodekso taikymo valstybės tarnybos teisiniuose santykiuose ypatumai, problemos bei šių problemų sprendimo būdai. Tyrimo esmę atspindi ir pasirinktas baigiamojo darbo tikslas – išanalizuoti darbo santykius reglamentuojančių teisės aktų taikymą valstybės tarnyboje. Darbas baigiamas pateikiant išvadas, kuriose konstatuota, jog Lietuvos Respublikos darbo kodekso nuostatų taikymas yra būtinas, įstatymų leidėjas darbo teisės normas įpareigojo taikyti tose valstybės tarnybos srityse, kurios nereikalauja valstybės įsikišimo, t.y. susijusios ne su valstybės tarnybos ypatingąja paskirtimi, bet su valstybės tarnautojo asmeninėmis teisėmis bei pareigomis.

The master’s thesis explores the specific aspects, problems and possible solutions concerning the application of the Labour Code of the Republic of Lithuania to the legal relations in public service. The essence of the study is reflected in the goal of the thesis, i. e. to analyse the application of statutory regulations governing employment relations in civil service. The thesis is finalised by providing conclusions which state that the application of the provisions of the Labour Code of the Republic of Lithuania is necessary, the legislator imposed an obligation to apply labour law regulations in those fields of civil service that do not require state intervention, i. e. that are related to the personal rights and obligations of a civil servant rather than the special purpose of civil service.
