Nepagrįsto praturtėjimo ar turto gavimo be pagrindo samprata šiuolaikinėje Lietuvos civilinėje teisėje

Sudėtingėjanti civilinė apyvarta skatina asmenis vis dažniau ginti savo pažeistas teises. Vienas iš civilinės teisės institutų, padedančių apginti savo interesus esant poreikiui išreikalauti turtą iš jį nepagrįstai įgijusio ir valdančio asmens, yra nepagrįstas praturtėjimas ar turto gavimas. Šiame magistro baigiamajame darbe yra atskleidžiama nepagrįsto praturtėjimo ar turto gavimo be pagrindo samprata šiuolaikinėje Lietuvos civilinėje teisėje. Tai yra daroma nustatant visų pirma nepagrįsto praturtėjimo ar turto gavimo reglamentavimą Lietuvos Respublikos civilinėje teisėje, po to analizuojant nepagrįsto praturtėjimo ir turto gavimo be pagrindo tarpusavio santykį. Toliau yra tiriamas nepagrįsto praturtėjimo ar turto gavimo reglamentavimas 1964 m. CK, jis palyginamas su 2000 m. LR CK įtvirtintu reguliavimu. Kadangi analizuojamas institutas turi nemažai bendrų bruožų su restitucija ir vindikacija, tai darbe yra aptariamos kiekvieno iš šių institutų taikymo sąlygos, jų teisinė prigimtis, galiausiai nustatomas nepagrįsto praturtėjimo ar turto gavimo santykis su restitucija ir vindikacija. Darbe yra vadovaujamasi teisės aktais, taip pat nemažai dėmesio yra skiriama teisės doktrinai. Viso darbo eigoje yra remiamasi teismų praktika. Siekiant didesnio išsamumo darbe yra tiriama, kaip analizuojamas institutas yra reguliuojamas ir aiškinamas kitų valstybių teisinėse sistemose.

The civil turnover becomes more complicated and this circumstance encourages persons to protect their violated rights. One of the civil rights institutes that helps to protect the own interests upon a need to exact property from the person having illicitly acquired and possessing it is the institute of unjust enrichment or reception of property not due. In this Master‘s Final Thesis, the conception of unjust enrichment or reception of property not due in modern civil law of Lithuania is disclosed. It is done by discussing, first of all, the regulation of unjust enrichment or reception of property not due in civil law of Republic of Lithuania and a subsequent analysis of the interrelation between unjust enrichment and reception of property not due. Then the regulation of unjust enrichment or reception of property not due in the Civil Code of the year 1964 is explored and compared to the regulation fixed in the Civil Code of Republic of Lithuania as of the year 2000. Because the institute under analysis has a considerable affinity with restitution and vindication, the conditions of application of each of the said institutions and their legal nature are discussed upon in the Thesis; finally, the interrelation between unjust enrichment or reception of property not due with restitution and vindication is established. In the Thesis, the relevant legal norms were observed; in addition, a considerable attention was paid to the doctrine of law. In the total course of development of the Thesis, practice of courts was used as a base. Striving for higher particularity, it is explored how the institute under analysis is regulated and interpreted in legal systems of other states.
