Magistro baigiamajame darbe yra analizuojamas mediacijos, kaip alternatyvaus ginčų sprendimo būdo, taikymas tarptautinio vaiko grobimo atvejais. Tyrimo tikslas yra identifikuoti mediacijos proceso teorinius pagrindus ir taikymo ypatybes, nagrinėjant bylas pagal Konvenciją dėl tarptautinio vaikų grobimo civilinių aspektų, bei įvertinti, ar nacionalinis teisinis reguliavimas ir mediatorių pasirengimas užtikrina veiksmingą vaiko ir tėvų interesų apsaugą mediacijos būdu sprendžiant dažnai itin sudėtingus šeimos ginčus dėl neteisėtai išvežto ar laikomo vaiko grąžinimo į jo nuolatinės gyvenamosios vietos valstybę. Atlikus tyrimą daroma išvada, kad Lietuvos teisės aktų nuostatos, reglamentuojančios mediacijos taikymą tarptautinio vaiko grobimo atvejais, yra orientuotos į vaiko interesų apsaugą, tačiau ne visada pakankamos tam, kad tėvai mediaciją rinktųsi savanoriškai, o Lietuvoje veikiantys mediatoriai nėra tinkamai pasirengę teikti mediacijos paslaugas tokio pobūdžio bylose.
The Master’s thesis analyses the use of mediation as an alternative method of dispute resolution in cases of international child abduction. The research aims to identify the theoretical fundamentals and specificities of the application of the mediation process in cases falling under the Convention on the Civil Aspects of International Child Abduction, and to assess whether the national legal framework and the training of mediators ensure the effective protection of the best interests of the child and the parents in the mediation of frequently highly complex family disputes concerning the return of a child unlawfully removed or retained to the country of his/her habitual residence. The research concludes that the provisions of the Lithuanian legislation on mediation in cases of international child abduction, while oriented towards the protection of the best interests of the child, are not always sufficient for parents to choose mediation voluntarily, and mediators in Lithuania are not adequately trained to provide mediation services in cases of this type of cases.
