Magistro baigiamajame darbe analizuojamas civilinio ieškinio institutas baudžiamajame procese, nagrinėjant teisę į žalos atlyginimą, žalos rūšis, civilinio ieškinio dalyvių teisinį statusą baudžiamojoje byloje, civilinio ieškinio pareiškimo, įrodinėjimo, garinėjimo ir išsprendimo procedūrinius aspektus. Magistro darbo tikslas - išsamiai ištirti civilinio ieškinio pareiškimo, įrodinėjimo ir išsprendimo baudžiamajame procese reguliavimo ir teisės taikymo problemas, ir pasiūlyti galimus teisinio reguliavimo bei taikymo praktikos tobulinimo būdus. Darbo tikslui pasiekti išsikelti uždaviniai: Išanalizuoti civilinio ieškinio, kaip žalos atlyginimo būdo, paskirtį baudžiamajame procese; Ištirti civilinio ieškovo ir civilinio atsakovo procesinį statusą bei jų teisių ir pareigų įgyvendinimą baudžiamajame procese; Nustatyti, kaip paskirstoma įrodinėjimo našta ir taikomi įrodinėjimo standartai nagrinėjant civilinį ieškinį baudžiamajame procese; Įvertinti procesinių palūkanų priteisimo praktiką; Įvertinti civilinio ieškinio išsprendimo būdus baudžiamajame procese. Rezultatai: Civilinis ieškinys baudžiamajame procese yra svarbi nukentėjusiojo teisės į žalos atlyginimą įgyvendinimo priemonė, leidžianti viename procese spręsti tiek baudžiamosios atsakomybės, tiek žalos atlyginimo klausimus. Tačiau tyrimas parodė, kad šio instituto taikymas nėra pakankamai aiškiai ir nuosekliai reglamentuotas. Civilinio ieškinio dualistinė prigimtis, kai taikomos tiek baudžiamojo, tiek civilinio proceso normos, praktikoje sukelia teisės taikymo problemų ir teisinio neapibrėžtumo. Dėl BPK ir CPK normų sąveikos ne visada užtikrinamas vienodas procesinių klausimų sprendimas. Nustatyta, kad civilinio ieškovo ir civilinio atsakovo procesinis statusas bei įrodinėjimo naštos paskirstymas baudžiamajame procese nėra pakankamai aiškūs, todėl teismų praktikoje kyla skirtingas šių klausimų aiškinimas. Tyrimas taip pat atskleidė problemas, susijusias su procesinių palūkanų priteisimu, ieškinio senaties termino taikymu bei civilinio ieškinio išsprendimu nutraukus baudžiamąją bylą. Magistro darbą sudaro įvadas, santrumpų sąrašas, du dėstomosios dalies skyriai, išvados, naudotos literatūros sąrašas, santrauka lietuvių kalba ir santrauka anglų kalba. Darbe taikyti tokie metodai: sisteminė analizė, teismų praktikos analizė.
The master's thesis analyzes the institute of civil claim in criminal proceedings, examining the right to compensation for damage, types of damage, the legal status of civil claim participants in a criminal case, procedural aspects of filing, proving, evaporating and resolving a civil claim. The purpose of the master's thesis is to thoroughly investigate the problems of regulation and application of law in filing, proving and resolving a civil claim in criminal proceedings, and to propose possible ways to improve the practice of legal regulation and application. The following tasks were set to achieve the purpose of the work: To analyze the purpose of a civil claim as a method of compensation for damage in criminal proceedings; To examine the procedural status of the civil plaintiff and civil defendant and the implementation of their rights and obligations in criminal proceedings; To determine how the burden of proof is distributed and the standards of proof applied when examining a civil claim in criminal proceedings; To evaluate the practice of awarding procedural interest; To evaluate the methods of resolving a civil claim in criminal proceedings. Results: A civil claim in criminal proceedings is an important means of implementing the victim's right to compensation for damage, allowing to resolve both criminal liability and compensation for damage issues in one proceeding. However, the study showed that the application of this institute is not regulated clearly and consistently enough. The dual nature of a civil claim, when both criminal and civil procedure norms are applied, in practice causes problems in the application of law and legal uncertainty. Due to the interaction of the norms of the CPK and the CPK, a uniform solution to procedural issues is not always ensured. It was established that the procedural status of the civil plaintiff and the civil defendant and the distribution of the burden of proof in criminal proceedings are not sufficiently clear, therefore, different interpretations of these issues arise in judicial practice. The study also revealed problems related to the award of procedural interest, the application of the statute of limitations for claims, and the resolution of a civil claim after the termination of the criminal case. The master's thesis consists of an introduction, a list of abbreviations, two chapters of the teaching part, conclusions, a list of used literature, a summary in Lithuanian and a summary in English. The following methods were applied in the work: systematic analysis, analysis of case law.
