Diskriminavimo draudimo principo įtaka tautinių mažumų apsaugai

Magistro baigiamajame darbe analizuojama diskriminavimo draudimo principo įtaka tautinėms mažumoms priklausančių asmenų kalbinėms garantijoms švietimo srityje. Tyrimo tikslas – išnagrinėti šio principo įtaką tautinėms mažumoms priklausančių asmenų kalbinėms garantijoms švietimo srityje bei palyginti Lietuvos Respublikos nacionalinės teisės atitiktį tarptautiniams standartams. Darbe nagrinėjama diskriminavimo draudimo principo samprata, draudžiami su tautinėmis mažumomis susiję diskriminavimo pagrindai, tarptautinių institucijų praktika, Konstitucinio Teismo ir LVAT jurisprudencija, taip pat tautinėms mažumoms priklausančių asmenų teisė mokytis tautinės mažumos kalba, teisė mokytis tautinės mažumos kalbos kaip atskiro dalyko ir lietuvių kalbos ir literatūros valstybinio brandos egzamino problematika. Atlikus tyrimą nustatyta, kad vien diskriminavimo draudimo principo nepakanka veiksmingai tautinių mažumų kalbinių garantijų apsaugai užtikrinti. Lietuvos Respublikos nacionaliniu lygmeniu tautinėms mažumoms priklausantiems asmenims suteikiama teisė mokytis mažumos kalba ir mažumos kalbos kaip atskiro dalyko, tačiau teisės mokytis mažumos kalba įgyvendinimas nėra pakankamai aiškiai apibrėžtas. Tyrimas parodė, kad Švietimo įstatyme įtvirtinta teisė mokytis mažumos kalba dėl savo neapibrėžtumo kelia riziką nevienodam šios garantijos įgyvendinimui skirtingose švietimo įstaigose ir gali lemti faktinę tautinėms mažumoms priklausančių mokinių nelygybę. Nagrinėjant LVAT praktiką magistrantas nurodė, kad Teismas pagrįstai priėmė sprendimą pripažinti Bendrųjų ugdymo planų nuostatas prieštaraujančiomis Švietimo įstatymo 30 straipsnio 2 daliai, tačiau šio sprendimo priėmimo skuba ir nepakankamas pereinamasis laikotarpis gali sukelti praktinių sunkumų tautinių mažumų mokykloms bei turėti įtakos tautinių mažumų mokyklų mokinių mokymosi rezultatams. Tuo metu lietuvių kalbos ir literatūros VBE modelis, pagal kurį tautinių mažumų mokyklų mokiniai egzaminą laiko pagal vienodą modelį kaip ir lietuvių mokomąja kalba veikiančių mokyklų mokiniai, gali kelti netiesioginės diskriminacijos riziką. Atsižvelgiant į tyrimo rezultatus, darbe siūloma aiškiau apibrėžti valstybine ir tautinės mažumos kalba vykdomo ugdymo santykį bei numatyti pareigą empiriškai vertinti vienodo lietuvių kalbos ir literatūros VBE modelio poveikį tautinių mažumų mokiniams.
This master’s thesis analyzes the impact of the principle of non-discrimination on the linguistic guarantees of persons belonging to national minorities in the field of education. The aim of the study is to examine the impact of this principle on the linguistic guarantees of persons belonging to national minorities in the field of education and to compare the compliance of the national law of the Republic of Lithuania with international standards. The paper examines the concept of the principle of non-discrimination, the prohibited grounds for discrimination related to national minorities, the practice of international institutions, the case law of the Constitutional Court and the Supreme Administrative Court of Lithuania, as well as the right of persons belonging to national minorities to receive education in the language of the national minority, the right to study the language of the national minority as a separate subject, and the issues surrounding the state maturity examination in the Lithuanian language and literature. The study found that the principle of non-discrimination alone is insufficient to effectively ensure the protection of linguistic guarantees for national minorities. At the national level in the Republic of Lithuania, persons belonging to national minorities are granted the right to receive education in the minority language and to study the minority language as a separate subject; however, the implementation of the right to receive education in the minority language is not defined with sufficient clarity. The study showed that the right to be educated in a minority language, as enshrined in the Law on Education, poses a risk of uneven implementation of this guarantee across different educational institutions due to its vagueness and may result in de facto inequality for students belonging to national minorities. In analyzing the practice of the Supreme Administrative Court of Lithuania, the master’s student noted that the Court rightly ruled that the provisions of the General Education Plans conflict with Article 30(2) of the Education Law; however, the haste with which this decision was made and the insufficient transition period may cause practical difficulties for national minority schools and affect the academic performance of students in such schools. Meanwhile, the model for the Lithuanian Language and Literature VBE, under which students at national minority schools take the exam according to the same model as students at schools operating in Lithuanian as the language of instruction, may pose a risk of indirect discrimination. Based on the study’s findings, this paper proposes to more clearly define the relationship between education conducted in the state language and that conducted in the language of a national minority, and to establish an obligation to empirically assess the impact of the uniform model of the VBE in Lithuanian language and literature on students from national minority schools.
