Demokratinėje valstybėje viešasis valdymas yra grindžiamas teisėtumo, atsakomybės, skaidrumo ir nešališkumo principais. Valstybės tarnyba yra neatskiriama viešojo sektoriaus dalis, kurioje viešųjų ir privačių interesų derinimo problemos, rizikos, interesų konfliktai pasireiškia per valstybės tarnautojų ir kitų viešajame sektoriuje dirbančių asmenų veiklą, todėl tyrimo tema apima ir platesnį viešojo sektoriaus segmentą. Asmenys, kuriems suteikti įgaliojimai, tam tikra galia priimti sprendimus dėl viešųjų išteklių paskirstymo, finansavimo, licencijavimo, leidimų išdavimo, personalo valdymo, viešųjų paslaugų ir kitų visuomenei reikšmingų klausimų procesuose, gali priimti šališkus, neteisėtus sprendimus ir taip sukelti interesų konfliktą ar korupciją. Atliekamos funkcijos turi būti įgyvendinamos atskiriant viešąjį ir privatų interesą, tik taip galėsime užtikrinti skaidrų viešąjį valdymą ir visuomenės pasitikėjimą. Nors Lietuvoje yra sukurta teisinė bazė, viešųjų ir privačių interesų derinimas yra reglamentuojamas, tačiau praktikoje išvengti interesų konfliktų ar korupcijos vis dar išlieka sudėtinga pagrindinė gerojo viešojo valdymo užduotis. Dažniausiai rizikos yra susijusios su rizikos situacijų atpažinimu, deklaravimo formalumu, nusišalinimo procedūromis, atsakomybės taikymu, kontrole ir formaliu valdymo ir prevencinių priemonių įgyvendinimu. Probleminis klausimas: kokios viešųjų ir privačių interesų derinimo priemonės valstybės tarnyboje ir viešojo sektoriaus institucijose nėra pakankamai veiksmingos, užtikrinant interesų konflikto identifikavimą, kontrolę ir prevenciją, kokios galimos tobulinimo sritys ? Darbo tikslas – atskleisti ir įvertinti interesų derinimo praktiką, konfliktų atpažinimo ir rizikos situacijų valdymo, prevencijos ir teisinio reguliavimo spragas, valstybės tarnyboje ir viešojo sektoriaus institucijose. Remiantis mokslinės literatūros analize ir ekspertų įžvalgomis, parengti pagrįstas rekomendacijas interesų konfliktų prevencijos ir valdymo stiprinimui. Darbo metodai – mokslinės literatūros, teisės aktų, statistinių duomenų analizė, kokybinis tyrimas - pusiau struktūruotas interviu, gautų duomenų analizė – kokybinės turinio analizės metodu. Darbo uždaviniai: 1. Atskleisti, kokiose situacijose praktikoje dažniausiai atsiranda interesų konfliktų rizikos; 2. Išanalizuoti, kaip praktikoje veikia interesų deklaravimas, nusišalinimas ir dokumentavimo procedūros; 3. Atskleisti, kokios prevencijos priemonės veikia efektyviausiai (mokymai, konsultavimas, etikos standartai, vadovo lyderystė) ir kaip jų efektyvumą vertina ekspertai; 4. Atskleisti nešališkų sprendimų priėmimo problemines sritis, etikos, moralės ir teisės kontekste, viešųjų ir privačių interesų konfliktų valdymo situaciją, įvertinant atsakomybės ir kontrolės procedūrų valdymo efektyvumą, taikymo nuoseklumą; 5. Empiriškai surinkti ir interpretuotai pritaikyti duomenis kurie padėtų identifikuoti praktikoje vyraujančias problemas ir suformuluoti rekomendacijas, kaip būtų galima tobulinti viešųjų ir privačių interesų derinimo sistemą. Gauti rezultatai – tikslas pasiektas, atskleistos pagrindinės viešųjų ir privačių interesų derinimo problemos, identifikuotos pagrindinės valdymo, priežiūros ir teisinio reguliavimo spragos. Parengtos išvados – bendrai įvertinus viešųjų ir privačių interesų derinimo problematiką ir veikiančius valdymo mechanizmus, galime teigti, kad viešųjų ir privačių interesų derinimo sistema turėtų būti tobulinama. Tyrimo metu pateiktos ekspertų įžvalgos ir faktinės pažeidimų situacijos dar labiau patvirtina teiginį, kad yra labai reikalingas vadovo lyderystės vaidmuo, nes trūksta praktinio įgyvendinimo, tai galime sustiprinti patikslinant, papildant įstatymus. Kitas svarbus aspektas - viešųjų ir privačių interesų derinimo procedūrose ir kontrolėje nėra vieningos valdymo prieigos, duomenų keitimosi su institucijomis, tam didelę įtaką turi asmens duomenų apsauga, tačiau VTEK, STT institucijos turi tūrėti visas prieigas prie sprendimo priėmimo procedūros, reikalinga sąveikaujanti sistema su kitomis duomenų, bazėmis ir registrais. Konsultavimo kanalai yra sukurti vidiniai ir išoriniai, galintys padėti suvaldyti interesų konfliktus, tačiau jų veiksmingumą turime stiprinti. Reikalingas institucijų veiklos viešumas, vidinė komunikacija, kurioje neliktų baimės pranešti ar taikyti poveikio priemonę už pažeidimus, turime didinti visuomenės sąmoningumą ir keisti darbuotojų elgseną ir nuostatas.
In a democratic state, public administration is based on the principles of legality, accountability, transparency, and impartiality. The civil service is an integral part of the public sector, where problems, risk, and conflicts of interest to related public and private interests private interests manifest themselves through the activities of civil servants and other individuals working in the public sector; therefore, the research topic also covers a broader segment of the public sector. Individuals who have been granted powers and a certain authority to make decisions the regarding the allocation of public resources, financing, licensing, the issuance of permits, personnel management, public services, and other matters of public importance may make biased or unlawful decisions, thereby causing a conflict of interest or corruption. The functions performed must be carried out by separating public and private interests; only in this way can we ensure transparent public governance and public trust. Although a legal framework has been established in Lithuania and the reconciliation of public and private interests is regulated, in practice, avoiding conflicts of interest or corruption remains a complex and fundamental challenge for good public governance. Most often, risks are associated with the identification of risk situations, the formality of declarations, recusal procedures, the application of accountability, oversight, and the formal implementation of management and preventive measures. Research question: Which measures for reconciling public and private interests in the civil service and public sector institutions are not sufficiently effective in ensuring the identification, control, and prevention of conflicts of interest, and what are the potential areas for improvement? The aim of this study is to reveal and evaluate the practices of reconciling interests, the gaps in conflict identification, risk situation management, prevention, and legal regulation within the civil service and public sector institutions. Based on an analysis of the scientific literature and expert insights, the study aims to develop well-founded recommendations for strengthening the prevention and management of conflicts of interest. Research methods: analysis of academic literature, legislation, and statistical data; qualitative research—semi-structured interviews; analysis of collected data using the qualitative content analysis method. Research objectives: 1. To identify the situations in which the risk of conflicts of interest most frequently arises in practice; 2. To analyze how the procedures for declaring interests, recusal, and documentation function in practice; 3. To identify which preventive measures are most effective (training, consulting, ethical standards, managerial leadership) and how experts evaluate their effectiveness; 4. To identify problem areas in impartial decision-making within the context of ethics, morality, and law, as well as the situation of managing conflicts between public and private interests, while assessing the effectiveness of accountability and control procedures and the consistency of their application; 5. To empirically collect interpretively apply data that would help identify the prevailing problems in practice and formulate recommendations on how the improve the system for reconciling public and private interests could be improved. Results obtained – the objective was achieved: the main problems in the reconciliation of public and private interests were revealed, and the main gaps in management, supervision, and legal regulation were identified. Conclusions drawn – after a comprehensive assessment of the issues surrounding the reconciliation of public and private interests and the existing management mechanisms, we can state that the system for reconciling public and private interests should be improved. The expert insights and actual cases of violations presented during the study further confirm the assertion that managerial leadership is critically important, as there is a lack of practical implementation; this can be strengthened by amending and supplementing the laws. Another important aspect is that there is no unified management approach in the procedures and oversight of the reconciliation of public and private interests, nor is there data exchange with institutions; personal data protection has a significant influence on this. However, VTEK and STT institutions must have full access to the decision-making procedure, and an interoperable system with other databases and registries is required. Internal and external consultation channels have been established to help manage conflicts of interest, but their effectiveness must be strengthened. Transparency in institutional operations is required, as is internal communication that eliminates the fear of reporting violations or applying impact measures for violations; we must raise public awareness and change employee behavior and attitudes.
