Privačių interesų deklaracijų duomenų kokybė ir jų panaudojamumas interesų konfliktų prevencijai Lietuvoje

Viešajame sektoriuje vis daugiau dėmesio skiriama duomenimis grįstam valdymui, skaidrumui ir interesų konfliktų prevencijai. Privačių interesų deklaravimas yra viena iš priemonių, padedančių atskleisti galimas viešųjų ir privačių interesų sankirtas. Deklaravimo sistemos veiksmingumas priklauso ne vien nuo pareigos deklaruoti ar deklaracijų viešumo, bet ir nuo to, ar deklaracijose sukaupti duomenys yra kokybiški, struktūruoti ir tinkami rizikų analizei. Lietuvoje 2020–2021 m. įgyvendinta privačių interesų deklaravimo sistemos pertvarka ir pradėjęs veikti Privačių interesų registras sudarė prielaidas keisti deklaravimo duomenų tvarkymo modelį. Problema formuluojama klausimu: ar ši pertvarka realiai pagerino deklaracijų duomenų kokybę ir jų tinkamumą interesų konfliktų prevencijai, ar daugiausia pakeitė tik deklaravimo formą ir techninę aplinką. Darbo tikslas – nustatyti, kaip 2020–2021 m. Lietuvoje įgyvendinta privačių interesų deklaravimo sistemos pertvarka paveikė deklaracijų duomenų kokybę ir jų panaudojimo galimybes interesų konfliktų prevencijai viešajame sektoriuje. Darbo uždaviniai: 1) išanalizuoti privačių interesų deklaravimo sistemos raidą Lietuvoje ir 2020–2021 m. pertvarkos prielaidas viešojo administravimo kontekste; 2) apibrėžti privačių interesų deklaracijų duomenų kokybės vertinimo kriterijus, aktualius interesų konfliktų prevencijai; 3) atlikti lyginamąją deklaracijų duomenų analizę iki reformos ir po jos, vertinant duomenų pilnumą, struktūruotumą ir kitus analitiniu požiūriu reikšmingus požymius; 4) įvertinti, kaip po reformos pasikeitė deklaracijų duomenų panaudojimo galimybės privačių interesų konfliktų rizikoms identifikuoti; 5) remiantis tyrimo rezultatais, pateikti siūlymus dėl privačių interesų deklaracijų duomenų kokybės ir jų analitinio panaudojimo tobulinimo. Darbo metodai: mokslinės literatūros, teisės aktų ir institucinių dokumentų analizė, kiekybinė lyginamoji administracinių duomenų analizė, statistinis duomenų apdorojimas ir rezultatų vizualizavimas. Empiriniam tyrimui naudoti Vyriausiosios tarnybinės etikos komisijos pateikti anonimizuoti savivaldybių tarybų narių privačių interesų deklaracijų duomenys. Lyginti du laikotarpiai: iki reformos sukaupti 2018–2019 m. duomenys ir po reformos PINREG sistemoje sukaupti 2023–2024 m. duomenys. Pagrindiniai darbo rezultatai: nustatyta, kad po reformos deklaracijų duomenų kokybė pagerėjo tik iš dalies. PINREG sukūrimas sudarė prielaidas centralizuotam duomenų tvarkymui, geresniam kai kurių duomenų laukų standartizavimui ir techniniam apdorojamumui. Ypač pagerėjo darboviečių ir sutuoktinio ar partnerio darboviečių duomenų pilnumas, taip pat kai kurių datos laukų tinkamumas analizei. Reformos poveikis skirtingoms duomenų grupėms buvo nevienodas. Deklaracijų, turinčių ryšių su juridiniais asmenimis, dalis sumažėjo nuo 89,6 proc. iki 76,3 proc., o deklaracijų, turinčių sandorių, dalis – nuo 48,6 proc. iki 28,0 proc. Pagrindinės išvados: po reformos duomenys tapo techniškai lengviau apdorojami, tačiau sumažėjo dalis sudėtingesnei interesų konfliktų rizikų analizei reikšmingų duomenų derinių. Deklaracijų, turinčių ir ryšį su juridiniu asmeniu, ir sandorį, dalis sumažėjo nuo 44,9 proc. iki 22,3 proc., o deklaracijų, turinčių visas keturias susijusias duomenų grupes, dalis – nuo 35,3 proc. iki 17,7 proc. Pagrindinė tyrimo hipotezė pasitvirtino iš dalies: reforma pagerino kai kuriuos deklaracijų duomenų kokybės ir techninio apdorojamumo aspektus, tačiau nepasitvirtino prielaida, kad ji vienareikšmiškai padidino deklaracijų analitinį panaudojamumą interesų konfliktų prevencijai. Tyrimas parodė, kad privačių interesų deklaracijų duomenų kokybės tobulinimas turėtų būti siejamas ne tik su techniniu duomenų tvarkymu, bet ir su turinio aprėptimi, ryšių tarp duomenų grupių išsaugojimu ir galimybe duomenis naudoti rizika grįstai prevencijai.
In the public sector, increasing attention is being paid to data-driven governance, transparency, and the prevention of conflicts of interest. The declaration of private interests is one of the measures that helps to identify potential conflicts between public and private interests. However, the effectiveness of the declaration system depends not only on the obligation to declare or the public nature of the declarations, but also on whether the data collected in the declarations is of high quality, structured, and suitable for risk analysis. The reform of the private interest declaration system implemented in Lithuania in 2020–2021 and the launch of the Private Interests Register created the conditions for changing the model for managing declaration data. The problem is formulated as follows: did this reform actually improve the quality of declaration data and its suitability for preventing conflicts of interest, or did it primarily change only the form of declaration and the technical environment? The objective of this study is to determine how the reform of the private interests declaration system implemented in Lithuania in 2020–2021 affected the quality of declaration data and the possibilities for using it to prevent conflicts of interest in the public sector. Objectives: 1) to analyze the evolution of the system for declaring private interests in Lithuania and the rationale behind the 2020–2021 reforms in the context of public administration; 2) define criteria for assessing the quality of data in declarations of private interests that are relevant to the prevention of conflicts of interest; 3) conduct a comparative analysis of declaration data before and after the reform, evaluating the completeness, structure, and other analytically significant characteristics of the data; 4) assess how the possibilities for using declaration data to identify risks of conflicts of private interest have changed following the reform; 5) based on the research results, provide recommendations for improving the quality of private interest declaration data and its analytical use. Research methods: analysis of scientific literature, legislation, and institutional documents; quantitative comparative analysis of administrative data; statistical data processing; and visualization of results. The empirical study utilized anonymized data from municipal council members’ declarations of private interests provided by the Chief Official Ethics Commission. Two periods were compared: data collected in 2018–2019 prior to the reform and data collected in 2023–2024 in the PINREG system following the reform. Key findings: It was found that the quality of tax return data improved only partially following the reform. The creation of PINREG laid the groundwork for centralized data management, better standardization of certain data fields, and improved technical processability. In particular, the completeness of data on workplaces and the workplaces of spouses or partners improved, as did the suitability of certain date fields for analysis. However, the impact of the reform on different data groups was uneven. The proportion of declarations involving legal entities decreased from 89.6% to 76.3%, while the proportion of declarations involving transactions decreased from 48.6% to 28.0%. Key conclusions: Following the reform, the data became technically easier to process; however, the proportion of data sets relevant to more complex conflict-of-interest risk analysis decreased. The proportion of declarations containing both a connection to a legal entity and a transaction decreased from 44.9% to 22.3%, while the proportion of declarations containing all four relevant data groups decreased from 35.3% to 17.7%. The main hypothesis of the study was partially confirmed: the reform improved certain aspects of the quality and technical processability of declaration data, but the assumption that it unequivocally increased the analytical usability of declarations for the prevention of conflicts of interest was not confirmed. The study showed that improving the quality of private interest declaration data should be linked not only to technical data processing but also to content coverage, the preservation of relationships between data groups, and the ability to use the data for risk-based prevention.
