Teisminis bendradarbiavimas įrodymų rinkimui baudžiamajame procese

Šio magistro baigiamojo darbo tikslas yra išanalizavus Europos Sąjungos ir nacionalinį teisinį reguliavimą, Europos Sąjungos Teisingumo Teismo, Europos Žmogaus Teisių Teismo bei valstybių narių teismų praktiką ir mokslinę doktriną – atskleisti teisminio bendradarbiavimo renkant įrodymus baudžiamajame procese teisinį reguliavimą, šio bendradarbiavimo formas ir jų taikymo problematiką. Darbe analizuojamos Europos Sąjungos teisminio bendradarbiavimo baudžiamosiose bylose ištakos, esmė, principai ir formos, taip pat teisminio bendradarbiavimo renkant įrodymus baudžiamajame procese priemonės, jų taikymo problematika ir Europos tyrimo orderio, kaip pagrindinio įrodymų rinkimo tarp valstybių narių instrumento, reglamentavimas bei praktinis taikymas. Atlikta analizė atskleidė, kad nors Europos tyrimo orderis supaprastino ir paspartino įrodymų judėjimą tarp valstybių narių, jo taikymas praktikoje nėra nuoseklus ir vienodas. Darbe nustatyta, kad pagrindinės problemos kyla dėl skirtingų valstybių narių procesinių taisyklių, nevienodų įrodymų leistinumo standartų, nepakankamai aiškių šio instrumento taikymo ribų, procesinių garantijų užtikrinimo ir skaitmeninių duomenų panaudojimo baudžiamajame procese. Tyrimas leidžia daryti išvadą, kad veiksmingam teisminiam bendradarbiavimui būtinas aiškesnis Europos tyrimo orderio reglamentavimas, nuoseklesnis proceso dalyvių teisių užtikrinimas ir minimalių pagal teisminio bendradarbiavimo instrumentus gautų įrodymų panaudojimo standartų nustatymas.
The aim of this Master’s thesis is, by analysing European Union and national legal regulation, the case law of the Court of Justice of the European Union, the European Court of Human Rights and the courts of the Member States, as well as legal doctrine, to reveal the legal framework for judicial cooperation in the collection of evidence in criminal proceedings, the forms of such cooperation and the issues arising in their application. The thesis analyses the development, nature, principles and forms of judicial cooperation in criminal matters within the European Union, as well as the instruments of judicial cooperation in collecting evidence in criminal proceedings and the problems related to their application, with particular attention paid to the regulation and practical application of the European Investigation Order as the main instrument for collecting evidence between Member States. The analysis revealed that, although the European Investigation Order has simplified and accelerated the movement of evidence between Member States, its application in practice is neither consistent nor uniform. The study shows that the main problems arise from differences in the procedural rules of the Member States, divergent standards of admissibility of evidence, insufficiently clear limits on the application of this instrument, the ensuring of procedural guarantees and the use of digital data in criminal proceedings. The study leads to the conclusion that effective judicial cooperation requires clearer regulation of the European Investigation Order, more consistent safeguarding of the rights of participants in the proceedings, and the establishment of minimum standards for the use of evidence obtained through judicial cooperation instruments.
