Nusikalstamos veikos imitavimo modelis: teisiniai pagrindai ir realizavimo taktiniai ypatumai

Šiame magistro baigiamajame darbe analizuojama nusikalstamos veikos imitavimo modelio teisinis reguliavimas ir realizavimo taktiniai ypatumai, tai pat išryškinamos praktinės problemos kylančios modelį taikant įkalinimo įstaigose. Darbo tikslas – identifikuoti pagrindinius nusikalstamos veikos imitavimo modelio realizavimo taktinius ypatumus ir praktines problemas. Tam, kad būtų pasiektas išsikeltas darbo tikslas, iškelti trys uždaviniai: 1) apibrėžti „slaptų tyrimo veiksmų“ bei „nusikalstamos veikos imitavimo modelio“ sampratas; 2) išanalizuoti nacionalinėje ir kitų Europos Sąjungos šalių teisėje įtvirtintus nusikalstamos veikos imitavimo teisinius pagrindus; 3) identifikuoti nusikalstamos veikos imitavimo modelio realizavimo taktinius ypatumus ir praktines problemas. Pirmoje darbo dalyje apibrėžiamos „slaptų tyrimo veiksmų“ ir „nusikalstamos veikos imitavimo“ sampratos. Slaptais tyrimo veiksmas laikomos įstatymuose (BPK ir KŽĮ) įtvirtinti duomenų ir informacijos rinkimo būdai, laikantis įstatyme nustatytų reikalavimų, taikomi slaptai. Nusikalstamos veikos imitavimu laikomi įstatymų nustatyta tvarka sankcionuoti slapti kriminalinės žvalgybos ar ikiteisminio tyrimo veiksmai, kurių metu subjektai imituotoja nusikalstamą veiką, atlikdami nusikalstamos veikos požymius formaliai atitinkančius veiksmus. Antrojoje dalyje įvardijami nustatyti teisinio reglamentavimo ypatumai, jog BPK ir KŽĮ teisinis reguliavimas nusikalstamos veikos imitavimo srityje yra grindžiamas griežtomis sankcionavimo taisyklėmis bei aiškiu draudimu provokuoti asmenį daryti nusikalstamą veiką. Vis tik nacionaliniame teisniame reguliavime neapibrėžiami nusikalstamos veikos imitavimo taikymo maksimalūs terminai, kai kitų Europos Sąjungos šalių teisiniame reguliavime šie terminai yra aiškiai apibrėžti. Be to, teismų praktika formuoja aiškią taisyklę, kad nusikalstamos veikos imitavimo taikymo laikas turi būti optimalus, t. y. jie turi tęstis tiek, kiek reikia visiškai atskleisti ir užkardyti nusikalstamą veiką. Trečiojoje dalyje įvardijami identifikuoti nusikalstamos veikos imitavimo kodelio taikymo įkalinimo įstaigose realizavimo ypatumai bei kylančios praktinės problemos. Esminiai taktiniai ypatumai – sisteminė informacijos analizė ir viso tyrimo taktikos numatymas, asmens (modelisto) parinkimas atsižvelgiant į asmens individualias savybės, kompetencijas, techninių priemonių panaudojimas ir organizacinės priemonės, kurių imamasi asmens apsaugai užtikrinti. Pagrindinės praktinės problemos – gautos pirminės informacijos ne(patikimumas), ilgai trunkantis pasiruošimas, provokacija, asmens išsišifravimo rizika, techninių priemonių gedimai, modelisto baimė ir kompetencijų stoka bei informacijos apie atliekamą nusikalstamos veikos imitavimą sklaida.
This master's thesis analyzes the legal regulation of the criminal act simulation model and the tactical features of its implementation, as well as highlights practical problems arising from the application of the model in prisons. The aim of the work is to identify the main tactical features and practical problems of the implementation of the criminal act imitation model. In order to achieve the aim of the work, three tasks have been set: 1) to define the concepts of "covert investigative actions" and "criminal act imitation model"; 2) to analyze the legal foundations of criminal act imitation established in the law of the national and other European Union countries; 3) to identify the tactical features and practical problems of the implementation of the criminal act imitation model. The first part of the work defines the concepts of "covert investigative actions" and "criminal act imitation". Covert investigative actions are considered to be methods of collecting data and information established in laws (The Code of Criminal Procedure of the Republic of Lithuania and Criminal Intelligence Act), applied secretly in accordance with the requirements established by law. Imitation of a criminal act is considered to be secret criminal intelligence or pre-trial investigation actions sanctioned in accordance with the procedure established by law, during which subjects imitate a criminal act by performing actions that formally correspond to the characteristics of a criminal act. The second part identifies the established features of legal regulation, that the legal regulation of the imitation of a criminal act is based on strict sanctioning rules and a clear prohibition on provoking a person to commit a criminal act. However, the national legal regulation does not define the maximum terms for the application of imitation of a criminal act, when these terms are clearly defined in the legal regulation of other European Union countries. In addition, case law forms a clear rule that the time for applying imitation of a criminal act must be optimal, i.e. they must continue as long as necessary to fully reveal and prevent the criminal act. The third part identifies the features of the implementation of the criminal act imitation model in prisons and the emerging practical problems. The essential tactical features are: systematic information analysis and planning of the entire investigation tactics, selection of a person (modeler) taking into account the individual characteristics and competencies of the person, use of technical means and organizational measures taken to ensure the protection of the person. The main practical problems are the unreliability of the received initial information, long-term preparation, provocation, risk of the person being deciphered, failures of technical means, fear and lack of competencies of the modeler and dissemination of information about the imitation of the criminal act being performed.
